Hello everyone.


I have recently received a letter apparently from the HM Courts and Tribunal service, with some scary looking paperwork with it!! Letter dated 13/12, however received letters 18/12.
I have read through your very helpful posts and am pretty sure it is them scaring me with a letter before CCJ however how can I tell?
Is it at this stage where I send the email template within your newbies thread?

I didn’t know about the said offence until I received bailiff letters so nothing from the parking company and have no evidence of times in and times out.
The car park in question is quite frequently used by us and up until this day was always a free car park, I’m also quite sure that I was in the car park for around 10 minutes as i had mistakenly gone to the establishment on the wrong day, i therefore went back the next day and was told to enter my reg number, I responded by saying ‘oh no, I didn’t do it yesterday’ and the lady said she would sort it if anything came of it! However the first I knew about it was 7 months later with these bailiff letters. I then contacted the establishment and they stated that due to it being so long since the alleged offence they couldn’t help.
Since receiving these letters from HM courts, I have been able to find out who owns the land as recommended by you guys, however they were unwilling to help and frankly quite rude! 
So my question is, is it worth contacting parking eye regarding my times in and out, if it was a matter of 10-15 minutes are they not supposed to give a grace period? Which Email is best to use, as I’ve noticed two, one of which mentions relevant land? Or is that specific to Gatwick airport?

    You really need to tell the forum what the scary letter is.  At a guess it is probably notifying you that a claim has been lodged against you in which case you have to respond to the claim.

    I would suggest scanning/photocopying the letter and posting it in your thread but redacting any personal information, in particular any claim no and password.

    Have you moved address at some point and not updated your V5 details which would explain why you haven't received earlier correspondence?

    Yeah unfortunately we have recently moved and I haven’t updated my V5C, how do they eventually find out your address I wonder?
    Ive attached correspondence received, I’ve left out admission and defence pages but can scan them aswell if needed.
    When I first received these letters I attempted to respond using the password and username that they gave but it would not work! Admittedly I was ready to pay it through fear.

    All standard stuff and not scary at all but informing you not to ignore. Do you have a Government Gateway account? If not, that is the likely reason the attempt to login failed. Get yourself a Gateway a/c. When logged in, follow the guide in the NEWBIE sticky for AOS. They do a soft trace to find you. You are in a good place because the POC are sparse and vague and it is DCB Legal for which a bespoke defence is available. What is the issue date of the claim form? Tell us and regular @KeithP will be along to give you some deadlines.

    the issue date was the 13th of December, however didn’t actually arrive until the 18th. 
    Yes I can certainly work out how to get myself a government gateway account.
    so am I past the point of writing a strong email to the solicitors?

    With a Claim Issue Date of 13th December, you have until Thursday 2nd January 2025 to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Wednesday 15th January 2025 to file a Defence.
    That's over three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    You need to be aware that those Particulars of Claim are totally inadequate.
    Particularly this bit...


    So it is alleged that the driver 'breached the terms on the signs (the contract)'.

    And that allegation is then repeated - 'Reason: Vehicle Remained On Private Property In Breach Of The Prominently Displayed Terms And Conditions'.

    Nowhere in those Particulars is there any explanation of what the driver is alleged to have done wrong.
    This will be an easy win.
