Periodic Tenancy Notice Period

Hi All 

Our periodic tenancy runs from the 10th of the month, I notified our agents on the 9th/10th of this month that we intended to vacate the property (we are paid up until the 9th Jan) I indicated that we may wish to move out a week or so later. Therefore infact giving him 5/6weeks notice so a bit longer to sort themselves. 

Perhaps wrongly assuming that this would be fine and that I would just part pay for Jan - the land lord is now wanting us to pay until the 9th February 

Do I have any legs to stand on?

    Not really. You have given a month's notice as required and then said you want to stay after your notice period. You either leave on the 9th Jan or pay for another month because notice is from payment date to payment date. LL may not want to have viewings on the property until after you are gone and it's empty, so they won't need 'longer to sort themselves' and it's no advantage to them if you stay longer

    Formally, your notice needs to coincide with a full tenancy period. You can give 5-6 weeks advance notice as you've done, but the move out date needs to be on the 9th (ie. the final day of your periodic tenancy period). If you want to leave partway through a tenancy period, you either need to negotiate an early surrender (at the LL's discretion, not something they have to agree to) or you move out early and pay rent up until the end of the tenancy period.

    And just to add, if you say in your notice that you will move out on the 9th, but then stay beyond that time, the LL is entitled to charge you double rent for any extra time stayed. I'd make sure you specify your move out date and then stick to it.
