BMW EGR Urgent Recall

I have had a letter from BMW stating I need to return my car for the EGR to be replaced as there is a risk that it may catch fire.  So I have booked in with the local dealer for as soon as they can do it, which is the 22nd Jan 2025!  so how urgent is the actual risk?

This morning on the way to work the car just lost power and stopped, then smoke started appearing from under the bonnet and within 30 seconds the car was well alight. Fire brigade was called and arrived with 5 minutes, fantastic response, it took about 30 minutes for them to put the car out. 

Now I have no car and the insurance will not provide a loan vehicle as they say they only pay for loan vehicles after and accident!  not good for me just before Christmas.

As I have my car booked in to BMW for this recall do I have a claim against BMW for a fault they are aware off, and not doing such a repair immediately it was reported?  My insurance will pay out the market value of the car but this will not be sufficient to get a replacement of the same type and age as the one that has been lost!

Who would I need to contact at BMW to start such a claim?

  • Read your policy doc for courtesy/hire car after a total loss - but quite often it stops when the total loss is declared or the valuation offered.

    The recall is urgent - but that doesn't magically make the parts or space in the dealer's workshop available. They didn't say "don't drive the car in the meantime", did they?

    The very definition of market value is that it should be able to cover the cost of a direct replacement. How far apart is their valuation from what you think a replacement would cost?

    As for BMW's liability - you don't even know the cause was the EGR.
    Anyway, that's a job for your insurer now.
    Your loss is covered by the insurer, their loss may or may not be covered by BMW.
