I appreciate the advice and opinions given in relation to my post. That goes without dispute. I was not commenting against that. Just because hundreds of people manage the process easier, does not mean all others do. My username does not and will not reflect any personal learning / understanding issues that I may have. For your knowledge, that username was one I came up with when I was young playing nintendo. I apologise for any offence you have received, however you also need to understand that some people find things way more complicated and struggle with events like this. I took offence at what Coupon said. If I had thoroughly understood what I needed to do, I would not be asking further.
It should be obvious with my responses, that I am struggling. What isn't obvious about that? I am not at all ignoring the advice Keith gave. At the time, I did not know the difference between the template of defence and the 5 paragraphs fit for PCNs like this. It did not sink that the two should be merged, which is now clear and that I understand.
I do agree with what you say about it being better at the expense of getting it right, and sometimes it being put across blunt. All I ask is people have a little more understanding of other peoples struggles, difficulties and concerns. Regardless, sometimes people with difficulties should be seeking proper help, yes. I am ultimately trying to avoid any further costs from seeking solicitor / lawyer assistance. I said this in my original post. I love the fact that people on this forum go out of their way to give free advice, but IMHO I think more patience would go along way, as reading some responses makes me just want to sack it off and pay it. I am simply trying to understand and ensure I get it right, that is all.
@Le_Kirk Thank you, I appreciate that. What you said there gives me reassurance that I am now doing this correctly. I saw a great example on the forums this morning about how it should be structured which made me realise what I was doing wrong3 -
I found this written defence from another user on the forum that specifically focuses on my POC (to be inserted inbetween rest of defence and defence template)
Referring to the POC: paragraph 1 is denied. The Defendant is not indebted to the Claimant. Paragraph 2 is denied. No PCN was "issued on 15/01/2024" (the date of the alleged visit). Whilst the Defendant is the registered keeper, paragraphs 3 and 4 are denied. The Defendant is not liable and has seen no evidence of a breach of prominent terms. The quantum is hugely exaggerated (no PCN can be £170 on private land) and there were no damages incurred whatsoever. The Claimant is put to strict proof of all of their allegations. (not written by me, just changed the date)
The POC the user posted is the exact same as mine. I'm unsure if I would be able to use this. The paragraph 2 denies not having a PCN issued, which I did technically? Any other way of defending point 2 or can I use this?0 -

Paragraph 2 doesn't deny having a PCN issued. Read it again!
Yes that is your para 3 and you just need to change the date. Obviously it goes into the 30 paragraph Template Defence.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
