    In order to check if your earnings are high enough to get SSP you need to do the following.
    Take the date of your first day of sickness.  Then take your gross pay for the last payday you had before that date and the gross for the paydays in the seven weeks before that.  You then have the gross for eight weeks.  You must use what is paid in those eight weeks it does not matter when the wages were actually earned.  Divide the total wages by 8 to get the average.
    If this is £123 or higher you have enough earnings to qualify for SSP

    only work for the company for 2 months before this happened

    Was it exactly 2 months giving you 8 weeks pay @ £138?

    Are you paid weekly or monthly.

    If the period before the date of sickness is under 8 weeks the calculation gets a bit more complicated.  Could you give the details of gross wages received for all paydays with dates of payment and if first payday was not for a normal week ( eg did one day at work instead of two as started mid week )then how many days was it for.  Also what is your normal working pattern eg two days per week

    Hi, thanks thanks for advice, I received ssp1 back and I am not entitled to statutory sick pay because I haven’t earned enough since I have been there.

    It has been known for employers to sometime calculate this wrong.  Have you had any weeks when your earnings were below the figure you advised as your weekly pay or if you started part way through a week what were the details here.  If you want it checked you need to give details of your eight weekly gross pays for each pay-day that fell before the first day of your sickness or all paydays if less than eight (actual payment dates not when pay earned)  Was your first pay-day reduced (if included in these pay-days ) due to starting mid-week, if so details of normal pay week and why this was less eg paydays Mon Thurs normal started on Thurs.

    Thanks for replies but it was HR that told me I am not entitled to sick pay.  Can’t claim esa because I haven’t paid enough stamps and don’t think I will get universal credit because of my husbands wages.  Feel a bit stuck.

    As I said above sometimes employers have been known to get this wrong, not saying they have it is just a possibility, if you want to have it checked you need to give the details asked for.

    If your earnings were at least £123/week then you will be treated as having paid class 1 NI contributions. If you've worked in the last 2 tax years then you may qualify for New Style ESA. The tax years for a claim up until Saturday would be 2020/21 and 2021/22 but from Sunday this will change to 2021/22 and 2022/23. 

    For UC then you should use a benefits calculator to check entitlement. You will need to put both yourself and husbands details into it.
