Claim Form from DCB Legal - Template info?

Hi all,

I received a claim form from DCB Legal on behalf of UKPC on 10/12/24. Following the template defence thread advice I filed an acknowledgement of service on 17/12/24.

I intend to defend this claim by following the template, however have some extra information that I would like advice on whether or not to include.

  • The "offence" happened while viewing a property. The parking area is for registered users only. I confirmed with the estate agent if it was ok for me to park there for the duration of the viewing, which they said it would be - this was verbal unfortunately, I don't have written confirmation.
  • I ended up renting the property, as such the vehicle that has received this fine is actually now a registered user - though it wasn't at the time.
  • Due to this being while I was moving, the PCN must have gone to my old address, which has now lead to this being a claim form.
  • The duration of the "offence" was less than 20 minutes.

Is any of this worth mentioning in the template letter at all? Do I have a good chance of winning this claim? Thanks..

    No stories,  no embellishments,  stick to adapting paragraphs 2 &  3 only , using the recent basic POC rebuttals seen in other threads over the last few weeks 

    Chances are that it will be discontinued next year,  it's a war of attrition

    No.  Just use the para 3 that begins:

    "Regarding the POC"

    It is on every new defence in every DCB Legal claim thread, in November and December.  Click on a few.  You'll see.

    Do I have a good chance of winning this claim?
    We'd put money in them discontinuing in 6 months or so. You'll pay nothing. No hearing.

    10/12/24 is the issue date. I mistyped in my original post.

    With a Claim Issue Date of 10th December, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 13th January 2025 to file a Defence.

    That's over three weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
  • That is great info @KeithP, thanks again. I have been following the guide you linked so far but one question I have is where the paragraph that begins "Regarding the POC" is on the template, is there another one more specific to DCB?

    Appreciate these are questions you've probably answered a million times so thanks for the patience.

    Also to say that as a lurker I have successfully used the Gatwick PCN appeal template to get out of a fine there too, so thanks for a third time.

    That shows you some 'deny the POC' wording to include in your para 3.

    You could leave it at that, merely changing the date to suit. But some cases need a bit more (e.g. residential cases where the D needs to talk a bit about their tenancy or lease rights, or cases with specific issues such as payment apps or machines not working, of a keying error or double dip case).

    And of course use the whole Template Defence but we don't want to be shown it ... please!

    Then follow the first 12 steps in the Template Defence thread so that you don't need to ask about the DQ questions or the laughable Mediation phone call.

  • Thanks for the link, I'll go with that and change the date to fix it. 

    For my own understanding though, how does denying it like that actually work? I'd assume for a lot of cases (mine included) they have camera recordings of the "violation" at the time. Does just saying "No PCN was issued on ... The Defendant is not liable and has seen no evidence of a breach of prominent terms. " work because they fail to pursue these claims in court?

    Yes and because it's all true. No PCN was issued on the date of parking.

    Also by using the Template Defence, it sends them a message that you are on MSE, so they know it'll go to the wire and you won't settle.

    So they'll eventually discontinue.
