All the dates of your unavailability should be listed. Add a couple of days either side of each to give you some flex should you have flight delays, for example. Add in school holidays too (if you have school kids. Send a copy to the court and one to PE's solicitors (if they are using), otherwise to PE themselves if they are fronting the case.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi everyone, thanks so much for the assistance with the dates.

I've now received in the post a "reply to defence". Date on the document is 1 May but I only received it middle of last week.

It, of course, contains all the reasons why my defence is not sufficient to get me out of the original penalty, presumably with the added missed deadline fees on top.

My concern is that they're now saying to the court I need to request and pay for another hearing if I want to amend my defence in any way. Please see below a PDF of the pages with their reply. The other pages that were posted are copies of the letters that were sent to me that I never received as well as examples of their signage and where they are placed at this particular parking lot.

Please let me know if the above link doesn't work and I can try add it another way.

I would appreciate any ideas on how to proceed now. I have not had any correspondence from the courts regarding dates to appear in court so at a bit of a loss as to what the next step in the process is now?

As always, your advice is so very much appreciated. I can't believe I've been at this for over 6 month's now, so I can really be thankful for your contributions to what, most likely must be, some pretty silly questions!

    Don't get spooked!

My concern is that they're now saying to the court I need to request and pay for another hearing if I want to amend my defence in any way.
Standard scaremongering. You don't want to amend your defence, I assume, so this is just smoke & mirrors.

    Thanks for the advice.

I think by reading through their response they seem to have an answer for every thing. I guess that's the point and it's up to a judge to decide if their response fully counters my defence.

In terms of next steps, should I go through the arduous process of waiting on hold for God knows how long with the court to find out the court date, or just wait for a letter to arrive?

    Thank you!

  • Hi everyone,

    An update on my case.

I waited and waited, eventually I received a letter for a court date - 2 October 2025, 5 months since the last correspondence from anyone. I also received a 1 inch thick copy of ParkingEyes' defence which was naturally intimidating.

I was just about to message for advice in preparation for my court date next week when a mail hit my inbox yesterday.

This came from Parking Eye to me, CC'ing the local court:

"We are writing to notify you that we wish to discontinue the above numbered claim and that we now consider this matter to be closed. We request that the scheduled hearing please be vacated. Please see attached the Claimant’s Notice of Discontinuance."

    They also attached a
Notice of Discontinuance PDF signed by ParkingEye's "Claims Handler Team Leader".

I want to thank @Coupon-mad and fellow Saffa, @Umkomaas for your assistance. Not just with legal advice but emotional support to remind me to stick with it, stay committed and be ready to put the time in to prepare for the usual intimidation/extortion tactics from these snakes.

Please reach out if you'd like me to post a step-by-step process for my particular case. Ie. Parked, slightly overstayed by a couple minutes due to their app not being responsive, all correspondence sent to old address after moving just days before the infringement, discovered CCJ via NatWest, CCJ removed even though I had not updated my drivers license address.

Yay! You won even though it sounds like you forgot to file & serve a witness statement or evidence, as the Hearing Order told you to...

    anyway...

    ANOTHER ONE BITES THE DUST!

If you can fit this in please do it - FIGHTBACK ALERT - just two days to go!

Please do the government's Public Consultation. We need every poster to complete this vital survey before the deadline.

    See this thread:

    https://forums.moneysavingexpert.com/discussion/6617396/parking-code-of-practice-consultation-now-extended-closes-friday-26th-september/p1

We understand that you may need some pointers. It looks laborious, we get that. It doesn't matter; no knowledge is needed except re your own experiences so you can call out a scam industry and you'll protect millions of motorists and help change the law.

I've written some guidance to help focus new posters on the issues. I've covered almost every question, providing ideas if you agree with our stance on things like DRFs, which we say must be banned.

Ordinary people like you are falling victim to this scam over 18 million times per annum. Motorists need your voice added please.

    CLOSES THIS FRIDAY.

For ease and inspiration read the Which? response they've just published:
