@sourcrates
Looking for some advice please following the response to a CCA request. Pra have said the debt currently is unenforcable because they haven't provided statements. This initially felt like a win but they've said they can continue to contact me about the debt and have asked for a budget from me. They've also said they might sell the debt on. What's my best course of action here?Tilly Tidy 2024 = £88.99 / £2000 -
I've moved this to the general forum, what exactly have PRA said?
Are they actively requesting these from the original creditor?
Yes they can keep contacting you, an unenforceable debt only means they can`t take you to court, all other collection activity is still on the table.
If they sell the debt, you just tell whoever picks it up the history and previous events that led to this status.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. If they've said it's unenforcable then don't pay. They always try and get money out of you even if it is unenforcable, often trying some rather dubious tricks. They said mine was unenforcable but phoned me every other day and sent me emails about it every other week for about 18 months. They have been quiet for the last year or so though.Selling it on is a good thing as it makes the next owner less likely to be able to produce the CCA.

I'm guessing it might be a sit tight scenario and hope they don't produce statements?
Seperately, cabot replied to my proof of responsibility request and confirmed that they've been provided with a credit agreement for the accounts. Is it worth me now submitting a CCA request too? They have said "accounts on hold for 21 days... We may be able to offer a discounted settlement on your balances."Tilly Tidy 2024 = £88.99 / £2000 -
Tell them you have enforceable debts and as these are higher priority you will not be making payments to PRA.
Then ignore them0 -
That's typical of the kind of wording they use. They are telling you that it's unenforceable but are trying to raise as much doubt as possible in your mind to.try and get money out of you. I'd just thank them for confirming that its unenforceable and then ignore them until they provide statements, if they evet do. There's no point engaging any further as they will juat come out with the same rubbish and you don't want to prompt them to look any further by drawing attention to yourself.0

Hi, did you receive any statements at all from PRA for your Barclaycard? I feel I'm in a similar position.
What they have sent me only goes back 6 months roughly when PRA took of the debt from Barclays
Is that good enough or do I need all my statements?
Thanks

Hi.
In a similar position after also receiving a letter saying they could not produce the request for cca and that currently the debt was unenforceable. That was in September. This month I have received two emails looking for payment plans and one that attached some statements but still no CCA.
Yesterday I received a letter in the post demanding I contact them within 30 days or they will be referring my case to the litigation team. There is no reference on the letter that the debt is unenforceable. Not sure if this is a tactic. Should I respond with a reminder about cca and quoting previous letter... Or should I ignore.

I would respond once saying that you wont be paying anything until they produce the cca and wont respond to any further contact, and then completely ignore them until they do they do produce the CCA. They can be very devious and push things to within an inch of lyimg to try and scare and deceive you into paying.1
