You just couldn't make it up!  Perhaps being overwhelmed with private parking roboclaims might have some part to play?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

So where did the Court get the £90,000 from?

Must've been paid into court by the Defendant, who would then be highly delighted to get the money back. He has now disappeared.

Haha!  Terrible really though. So the Defendant paid it into court then got the money refunded.

Brighton court aren't the greatest at admin and memorably HHJ Simpkiss (Brighton/Lewes circuit) was worse than shocking in the Wilshaw case. Never seen a judge so ready to have the wool pulled over his eyes. Some of the admin staff were awful sometimes when I did cases there.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

"A judge has ordered the defendant to return the funds and we have additionally referred them to the police for investigation."

So in theory if they don't pay this couple will have to fork out for a warrant, or a charging order. The bailiffs might only get a car off him, of he could bankrupt himself!

But surely Mr and Mrs Cutts won't have to do any of that.

It seems that the Cutts only have to chase the court. It's the court's problem if they can't get the money back.
