  • Hey. I have spoken to CNBC today who have advised me that I have not received a reaponse t my defence as this claim has now been stayed because the claimant/DCB have not paid the fee/done what they need to do for the next stage of the process in time. Does anyone know if this is common practice from them? 

    I asked if I need to do anything and they advised I could contact DCB Legal and ask them if their client is intending to continue with the claim so just wondered if anyone on here would advise doing this or to just wait it out. Would much rather get this over with sooner rather than them getting back in touch another year down the line if they apply to lift the stay?

    I agree, and an indefinite stay means you'd have to stay on top of it (forever!) with no end date, just in case one day they lift the stay. You'd also have to tell the CNBC and DCB Legal and the Claimant if ever you move house in future.  No end date! Mad, innit?

    So email and ask DCB Legal whether they are leaving the case stayed and if so, tell them to note that your address for service will not remain the same indefinitely and if ever they decide on a greedy whim to apply to lift the stay, they must carry out a soft trace to check the address. This is their burden because you are not putting your life 'on hold' and nor will you accept the wholly unreasonable position of having to remember to effectively ask a notorious parking firm (from an industry whose conduct demonstrates a lack of social responsibility) for 'permission' to be away from home, go on holiday or into hospital or move house, for the rest of your life...

  • Thank you. I’ll contact them and see what the outcome is… absolutely poor form from them! Feel like this is all just wasting my time!!

    Hello. 
    An update in case anyone is interested. I contacted both DCB and the court following the above advice. I received written confirmation from DCB Legal that they have closed their file and are now taking no further action in relation to this case on their end. 

    Their correspondence said “ We confirm DCB Legal have proceeded to close our file and will take no further action regarding this matter as the claim has been stayed.”

    This is positive news however I am mindful I have not received a formal notice of discontinuation from the court as the proceedings are still stayed (I am guessing the parking company have simply ceased engaging?). 

    I spoke with the court who advised as the claim has been stayed the applicant would have to both pay a further court fee and make an application to a judge to have the stay lifted justifying their reasons. They advised me this is unlikely to happen and told me this happens a lot when people don’t wish to pursue something so said I should not worry. 

    I am not too concerned however as I do not have a formal notice I will be mindful to still notify the court should I change address in the future (just in case!!). 

    Any thoughts are welcome :)
