12 month warranty from "date of purchase"

I purchase a Zima dental cleaning device on 24 November 2023. The next day I got an email saying delivery of my device would be "delayed for up to 5 days due to high demand". Several days later it arrived.

I reported a fault with the device on 25 November 2024 but have been told my device was "out of warranty".

Their warranty states: "12 months from the date of purchase". However, how can any warranty start before the device has been received? Or for that matter, SENT? If I haven't received my device, then has the purchase even been completed? Seems like a terrible loophole if you're selling goods over the internet.

I understand if you're buying something from a shop in person, but if (for example) you purchased something and there was a delay of four weeks, how could a 12 month warranty really valid if you've only had it for 11 when the warranty expires?

In this case, it's a matter of hours!

Any warranty is over and above your statutory rights (it cannot restrict then). Beyond that however it is offered on whatever terms the manufacturer sets out.

You may still have a claim against the seller under consumer legislation if you can show that it failed due to an inherent problem and not, for example, due to misuse.

    Very common with computer kit
I recently bought a clearance unactivated brand new  iPhone 11 that was manufactured in 2019
Should Apple be honoring their warranty ?
    Not a chance
Mind you it only cost £150 for 128Gb so I am less than bothered
