Party Wall Act - owner now trying to claim all expenses for works due to me disputing initially

    You don't finish a business letter with the salutation "kind regards"! It should be "yours faithfully" and should start "Dear Sirs"
  • Wow sorry 😞 it’s probably that I’m so fed up coming through in my email?  and I am addressing to the solicitor like he addressed me! My English Degree is not paying for it’s self is it 😂

    I'll be honest here.   Your initial
    post didn't make a whole lot of sense.  There was a lot of switching of between he/she/they/it and it was very long and meandering.  

    Your subsequent posts seem to be about your own conversation with your insurance cover.  

    Using AI is great if you give it actual information, as it is, it's a very generic reply to something I still don't understand. 

    What has your neighbour actually done? Have you done anything to your own house at all?

    If you have a PW surveyor to ensure neighbourly compliance, what action do they recommend you take if the neighb fails to?
    Wouldn't this surveyor be your expert source in any action?

    Hi ok so he asked me a year ago to fit a wood burning stove to his house and he told me his flue would be on my roof due to terraced house and party wall shared I told him no as he wanted to install himself and his past workmanship is dreadful. He’s removed my fence damaged my tiles on my roof and my flue has been tampered with so I was cautious 
    when I looked into it the party wall I could see I could dispute and get professionals in so I did at his cost the award was written by my survey and his and issued it was 47 pages long and he had to adhere to it 
    a few weeks later he posted a handwritten note through my door saying he had asked a contractor to start works. He had to give me 2 weeks written notice so I assumed someone would be in touch. 2 hours later a contractor called with 3 roofers they did not know about the award and started works I stopped them as no notice had been given and no scaffolding on the back of our house and no other works were being done to the award.
    after a while the contractor whom I knew said look your flue is not right and he’s damaged your roof tiles missing and not put back etc.  he said let me put things right and fit his flue and it’s done, I felt pressured and said ok. 
    Works were done and they left.
    then 02-12-2024 I had a letter from the owners solicitor that I have been unreasonable and basically the £6000 he has had to pay for the flue he wants back and he’s not gutted the fire yet he would not allow the contractor to do this he wants to do it himself which is illegal 
    does that make sense?

    Hi sorry to ask what’s a PW 

    and yes I went back to my surveyor and he told me he so not there to police the award just to issue it and he wants to be paid he said !

    There is very little work that one can do to a house that is "illegal". Without proper qualifications, working with gas appliances is about the only thing that would fall under the heading of "illegal". One is permitted to undertake a wide range of work on a property, and very little requires any formal qualifications.

    to install a multi fuel stove you have to be HETAS or other qualified the owner once he removed the fire board fitted by the installer he is breaking the law as per regulations for a wood/multi fuel stove also if the owner fits it my insurance is void as he is not correctly qualified and insured that’s what my building surveyor told me he has to have the flue and fire fitted by a professional 

  • I’ve called and emailed my surveyor and he keeps telling me he cannot control what my neighbours is doing. The party wall award is all he does so I am at a loss now
