Smart Parking

Yet another case. My daughter and I were both given a PCN for being 11 minutes over time, one minute over the grace time. ( In total, 4 hours plus 11 minutes). The reason we were over was due to a 4 month infant not being well, It took some time (20 minutes or so) to calm her and make our way. We did inform Smart and POPLA. We went to POPLA appeal, my daughters appeal was successful, mine has not been. I cannot appeal again, they tell me. Does anyone have any idea how I should progress this? Thanks.

Leave it, apart from complaining about the PCN to the landowner or retail park management company or business known as plan A in the newbies sticky thread in announcements
You should have come here first, no keeper liability is an easy win, when the correct appeal is used, so do so in future
If you ever receive a Letter of Claim or court claim, come back to this thread2 -
Completely ignore Smart Parking. Perfectly safe.cyrilhoward said:Yet another case. My daughter and I were both given a PCN for being 11 minutes over time, one minute over the grace time. Not Scotland I assume?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Sit tight. Do nothing except the below.
By going confidently into the 'ignore' stance, the only steps to take (because you MUST check every letter) are:
- Tell them if you move house within 6 years.
- Ignore the tedious £170 threatograms shown in pictures in the 4th post of the NEWBIES thread.
- Come back if you get a solicitor's LBC as per the 2nd post of the NEWBIES thread.
Nobody pays a penny unless a Judge says so. There is no risk AT ALL in defending a court claim. No CCJ. No bailiffs. And - at the time of writing - Smart never sue anyone.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

An infant under 6 months should be covered by parts of the equality act.You do not have a fineYou do not have a penaltyyou were asked about the landowner, why havent you complained to them and told them to cancel the parking charge notice, issued by their agents?Whos car park was this, and where? From the Plain Language Commission:

Thanks to all,
I will stick to no comment.
The parking was at Dreamland (Margate). I did contact Dreamland twice, they informed me both times the parking building had been sold to smart parking and they could not help.
Thanks to all.
