Capital disregard: ESA, HB and CTR

I recently had a letter from my local council saying that they'd (over)charged me for 10 years for contributions to the cost of my care, it's around £40K. Originally I thought that I would have to come off my ESA, HB and CTR, but someone suggested to me that the £40K might be disregarded because it was the council's error. However, I can only see information about DWP errors, and most info seems related to ESA rather than HB and CTR. Please does anyone know if I can get this capital disregarded, and for which benefits?
