New generation parking fine from 2021

Hi I’ve received the court claim form following a letter from dcbl regarding a parking fine I incurred in May 2021. 

I barely remember the incident and wasn’t aware of a fine. Due to difficult reasons I had to leave Cardiff in July 2021 and then lived in temp accommodation until December 2021 so this was the first letter I had received. (Nov 2024)
i contacted dcbl explained the situation and my health conditions (serious mental health probs) and they were unable to help or offer any support - they just don’t care !!! 

Anyway I’ve send in the first part of the defence today to allow for more time and started on my defence. The whole thing is really stressful and I don’t deal well with this type of thing!!! 

Question is I have said in my defence I can’t recall the incident as it was so long ago and not received the letters etc. 
would it be best to include all the paragraphs of the template on my defence or is there something specific I can add about struggling with mental health. There is no way I could stand any type of court.

What does this sentence mean?...
   "Anyway I’ve send in the first part of the defence today to allow for more time and started on my defence".

Hopefully it means you have filed an Acknowledgment of Service and are now working on your Defence.
I am slightly concerned that you may have written something like "Defence to follow" in the Defence box. Please tell us you didn't do that.

What is the Issue Date on your Claim Form?

Upon what date did you file an Acknowledgment of Service?
Your MCOL Claim History will have the definitive answer to that.

Can you please show us a picture of the Particulars of Claim from your Claim Form - with all your personal detail hidden of course.

Yes I’ve sent in acknowledgment of service today - and no nothing extra written on! 

The issue date on the form is 22nd November. The letter prior to this (and the only letter I’ve received was 18th October)

With a Claim Issue Date of 22nd November, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 30th December 2024 to file a Defence.

That's over three weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.

To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.

Don't miss the deadline for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

Thanks I’ve made a start as I really don’t want it hanging over at Christmas or any time really!! 

Back to my first post would you suggest

I’m in quite a good place at the moment but my mental health is very fragile and I don’t want to risk a serious relapse

I watched the film yes. 

I don’t live in Cardiff anymore and haven’t since 2021 a so no idea where would be nearest. 

There is no chance of me going to find the said parking place to check lighting signage etc. 

I haven’t seen the other thread what is it ? 

I’ve looked at lots of threads where it says to not use personal stuff in the defence but tbh I don’t have any thing to say! I was basing my defence on my mental health condition and the problems surrounding. 

 I can hardly remember the parking incident and so much has happened since I don’t recall of there was a ticket machine or not. The fact is I never received any of the letters from the original ticket, the dcbl letter was the first one which was last month. 

I literally feel like just chucking the towel in and giving up on it !! Although there is no way I could pay the full amount as not working now due to my health. So really I am stuck.

I provided a 2 step link to the thread about discontinuations. Tagged usernames are links to posting profiles ... look again!

This is so much easier than you are building it up to be. There's a template defence where you only write one paragraph. And it doesn't even matter what you put because DCB Legal will discontinue before the hearing, regardless.

Just add brief info about the circumstances but also deny the allegations. As seen in every thread like this. There are loads of multiple PCN claim threads. We win 99% of the time!

I hate providing links to threads because it stops people seeing how to hop around and finding & reading threads for themselves. But in the spirit of the Season, here's one showing what to put for para 3, but please look around and read more (saves us from having to reply with the same stuff on thread after thread):

That shows you some 'deny the POC' wording to include in your para 3. Just add a line about the circumstances & facts that you know, or (if true) that it's too long ago to know any facts.

And of course use the Template Defence but we don't want to be shown it ... please!

Then follow the first 12 steps in the Template Defence thread so that you don't need to ask about the DQ questions or the laughable Mediation phone call.

We hope that we are only needed again by Defendants at WS & evidence stage next year. The 'first 12 steps' advice saves us all time.

 the link with the name wasn’t working but I’ve read the thread you suggested. I apologise if you believed I was building it up too much however as I explained I suffer with anxiety and poor mental health so part of this is catastrophic thinking. 

I’ve spent a couple of weeks reading lots of threads it was more about what amount of detail to write. 

Now this is clear I will continue with my defence letter.

Yes it was (is) working. What do you think a user's posting profile shows you when you look harder? It shows their threads.
