Stamp duty

My partner and I are buying a house together which will be our main residence. I don’t own other property but my partner does which he rents out. Do we pay the higher rate of SDLT?

    What are your partners current residential arrangements? If owner, is he selling main residence?

    If he is selling a main residence and you are buying a main residence for you both, then probably not. Your solicitor should get it right. The higher rate is usually on the second property not the first.
  • He recently sold his main residence and we are just awaiting the purchase of our new main residence which has taken longer than expected!

    As long as you complete the purchase of the new main residence within 3 years of him completing the sale of his previous main residence then condition D is not met, therefore the higher rate of SDLT will not be due.
