  • Oh and btw the reason I was sat in the car was due to my limited mobility the blue badge is mine the keeper and driver of said vehicle

    Almost every private car park (and most are) monitored by private parking firms are set up with the main objective of catching out and penalising motorists. Avoid any of them where possible, but if you have to use one, read very carefully what the signage says, and comply with it. Almost every sign will have something about parking correctly within the lines. 

    If you ever find yourself entering a car park operated by Excel Parking or Vehicle Control Services (VCS), leave immediately. In these you get only 5 minutes to pay, if you miss that timeline, it's £100. Their signs will take more than 5 minutes to read (let alone digest), and you've just been caught in the perfect trap!
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    You have received a  £100  "fine", its an early bird settlement offer that is £60, should you choose to pay it early doors 

    Otherwise it will revert to the maximum charge on the PCN and on the signs , which is the default. £100

    Plan A is still your best option here, throwing yourself on the mercy of the retail park management company or landowner and getting it cancelled as a one off gesture of goodwill, as I mentioned earlier today 

    So Plan A, ASAP

    It's not a fine and you won't be paying.

    Easiest tactic (if the landowner refuses to cancel it - try that FIRST) is simply to ignore UKPC as there's no appeal worth trying (mitigation is never considered).

    Ignore all  the usual tedious £170 threatograms and please DON'T show us those letters.  You'll already know all about that from when you read the 4th post of the NEWBIES FAQS thread.

    Tell them & their agents if you move house.

    Come back to us when you get a LBC in 2025 from DCB Legal or other 'solicitor' firm. You'll already know all about that from when you read the SECOND post of the NEWBIES FAQS thread (no link needed. See my signature):

  • Ok the retail park management company no website or number or email address, Capitol centre retail park Preston. To go back to the start of this post I attached the pic of the car parked over the yellow line I had no intention of looking for an excuse or hiding the fact that this was what caused receiving the letter I was just seeking some advice. I thought that this was an over zealous reaction from the operators of the site, however I feel that like many things going on today should I cow-tow back down and pay or should I say F you not paying take me to court? Would a court of law look favourably on a company trying extort money from a disabled pensioner? I have always maintained that if I F up I will be one to put my hand up but sometimes you have to say no. And lastly to the people explaining the rules of blue badge ownership, for the last three years I had refused to apply for one even though I could hardly walk, and only then when my daughter pleaded with me to do it. Giving in is not an option unless you absolutely have to.

    We've had 2 threads about that scam site in the past month; both were able to easily contact someone called Jessica. Clearly there is a contact email because posters found it.

    Yes.  But you won't have to attend court.

    We do this every day and UKPC cases don't even reach hearings.  We know what we're doing but ask Jessica to cancel.  I don't have that email address. You'll have to look for it online. UKPC deserve a barrage of complaints.

    If your statement above is in relation to my post all I was doing was giving a gentle hint in case you were not aware of the government regulations re. BB use and misuse/consequences (to prevent legitimate fines issued)  -  after all this is a money saving site.

    To come at this from a different angle, why does the car park only put a yellow box on one side in this spot (thanks for clarifying)? 
    If they were truly providing a parking space for extra access it would be on both sides as most do, not just one and there would be no need to straddle the yellow box.
    As it is it; 
    1) Forces the vehicle to park in a way that access is provided to the relevant door needed 
    2) If both sides require easy access you are stuffed. 

  • Just a quick update. I managed to contact the land owners and had correspondence with Gavin who is the regional facilities manager for the Capitol Retail Park Preston. UKPC were unwilling to back down however I managed to get a compromise reducing the demand for £100 down to £20. So lesson learned no more visits to retail parks.

    Its not just retail parks, its all private car parks, ports, stations. Airports, hospitals, medical practices, private car parks like multi stories , attractions, hotels, fast food restaurants , supermarkets etc
