Chased after 5 years (Scotland)

I got a chaser letter today, for a charge from December 2019. I'm in Scotland & our keeper liability addition hasn't had it's secondary legislation yet so the letter is gonna be ignored.

However, I googled how long they can pursue & it looks like it's 6 years. Seems a long time, and it did make me wonder if there will be a retrospective clause when ratified, allowing a window of previous 6 years charges?

Have no idea if that could be a thing in Scotland.

    6 years in England and Wales, only 5 years in Scotland, so ignore them

    I'd write a really sarky email that ends up referring them to the answer in Arkell v Pressdram.

    As far as I am aware, there are no limitations for bringing a prosecution in criminal law within any part of the UK, so crimial cases are never statute barred.

    In England and Wales, we have the Limitations Act 1980 that prohibits civil cases being pursued beyond six years, even if the allegd debt still exists.

    In Scottish law we have the Prescription and Limitation (Scotland) Act 1973 that prohibits civil cases beyond five years being pursued, and after which the alleged debt ceases to exist.

    i don't know anything about the laws in NI with regards to civil law limitations
    In this case, you're penultimate paragraph applies, which has already been mentioned on here.
