Stage coach death in service

Can someone advice me on my late partner who suddenly passed away this year. He worked for Stage Coach as a bus driver. When he started working for them he told me he put my name on his death in service beneficiary. I was his co-habiting partner for over 5 years we lived together and we were financially inter-independent on each other. His estranged family have suddenly come into the picture and causing issues. They have had NO contact with my partner since they kicked him out of his family home and made him homeless. Then my partner moved in with me.
I told Stage Coach that my partner put me down as his beneficiary on his death in service can i have a copy of this they said the trustee have the paperwork they cannot give this to me.
It has been 8 months since my partner passed away they still have not given me any confirmation on his death in service. what can i do?
Also if my name was on his death in service can his family take this off me?

Really sorry you find yourself in this position. Who this is paid out too is down to the trustees who can either follow the wishes of the deceased or use their discretion to pay to another claimant. The time to pay out is likely to be far longer when there are competing claims that they have to consider but I would certainly be perusing the trustees of the scheme for an update.
How close are these relatives? Unless they are his children I would have thought there claim would have little standing.1 -
I am sorry to hear of your loss and the problems you are having with your late partner's family
I understand that stating someone as a beneficiary of a DIS payment is only an expression of wishes and it is for the trustees of the funds to decide where the money goes. in the situation where there is a partner and perhaps blood relatives then the trustees will have to look fairly closely at this, I presume to see who is dependant / benefits from the will etc2 -
Given that you were financially dependent on him, and they were not, I would suggest that you make the point when you are chasing the Trustees that you are only doing so because you need the money. This reinforces the fact that were financial dependent on your partner, and it is unfair that they keep you hanging on for so long, when he has expressed his wishes. The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.1

Did he have a will? If he left everything to you that may be evidence that the trustees should take account of when deciding who to pay out to.1

My sympathies.
Was your partner still married by any chance?0 -

It isn't usual for trustees to provide a copy of any Expression of Wish (or Nomination) form. Even if the person asking is the only person named on that form, trustees still have to carry out 'due diligence' (fact finding) before taking a decision about the recipient(s), especially if the latest copy of the form is more than a couple of years old. If there are competing claims, it can take months for a decision to be reached.tacpot12 said:Given that you were financially dependent on him, and they were not, I would suggest that you make the point when you are chasing the Trustees that you are only doing so because you need the money. As above. It's just possible that your partner meant to complete the form and then didn't (it's an easy slip to make), so reinforcing your financial dependency is a very good idea.Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!2
