Flat extension not showing/mentioned in lease plan - legal recourse?

  • Solicitor here with 10 years of practice in leasehold matters. This shouldn't be an issue for the purposes of your purchase however you should seek reassurance from the freeholder that they will enter into a Deed of Variation of the lease plan once you have purchased (and the time pressures are off), purely because a future purchaser (or their mortgage provider) may take issue with it.

    But it basically comes down to the lender not being able to tick a box; there is no real issue here and no one can ask you to remove the extension. Something else you should ask your solicitor is how liability for maintenance and repair of the extension is dealt with between leaseholder and freeholder, if the area isn't mentioned within the lease. If you google 'peppercorn law licence to alter guide', you'll see that the part that has been missed out in your case is the tidying up part at the the end of process, rather than something as bag as lack of consent etc. Hope this helps but DM me if you want any more input.
