    Yes - as others have said it's a tricky tightrope Stepchange walk - their service can be extremely valuable for someone starting out and totally overwhelmed - but I dislike their tendency to encourage people to rush into the DMP without fully explaining al the options. wouldn't be without them, but rather wish they ran things differently while fully understanding the reasons why they can't!

    It certainly sounds as though you have outgrown the need for them now. In your position I think I would email them to stop the DMP, then as said, get standing orders set up to all those accounts where the debt IS still enforeceable - those who cannot provide a CCA or you are still waiting to hear from go on the back burner for now, You then have a choice - increase your DMP payments to each of the enforceable debts or continue paying them the same and stash the "spare" money away ahead of being in a position to make full and final offers along the line.

    I had the CCA provided for a 14 year old debt but with a 20 year old one  they couldn't find it. I've also heard of cases where it can't be found for debts that are only a few years old. There is no point trying to guess really,  see how it plays out and just deal with the ones that turn out to be enforceable. If any are enforceable you could make minimal payments and save up to make settlement offers further down the line.

    I don't think you should go to a TSB branch. If you have made the CCA request in writing then if they haven't provided the CCA within 12 days it becomes unenforceable until they do. There is no sense in going out of your way to make it enforceable.

     the tsb one is an overdraft so it would be enforceable  I think ? I’ll report back though if I get the CCAs . How long do they have to provide the CCA ? Indefinitely after the initial 12 days?

    Yes. I think the 12 days thing was removed from the legislation.

    It is unenforceable indefinitely under the CCA until they comply.


    Assuming you are not paying, it eventually becomes unenforceable under the Limitation Act, and that is irreversible

    That last line of fatbelly's post above is the reason to stop paying when CCAs have not been provided once demanded - if the creditor never gets round to finding it, eventually Limitation kicks in, and then you have a debt you can permanently tick off! 

    well done for cancelling with Stepchange - exciting stuff - now you are fully in control!

    So the first letter has arrived since cancelling StepChange from Cabot - regarding account which they can’t find CCA for yet 
    do I messsge them telling them I’m not paying till they provide CCA or ignore?

    I suggest telling them you will not set up a payment arrangement while the debt is unenforceable as no CCA has been supplied.

    I would just ignore them from now on personally. My experience with PRA was that they just kept pestering me anyway. If you do tell them you aren't paying then say it once then ignore them, don't get into further discussions. 

    It's nice to see that they have clearly told you it's unenforceable in the smallest text they can get away with at the very bottom.
