Group nexus parking charge for overstaying

Received paking charge. Absolutely no idea I had to pay, met a friend for coffee at Moto, I thought the carpark was part of Moto, Costa etc. £60 if paid within 14 days of letter, which now gives me just 4 days to react...or £100 if don't.  Please advise, I  want to ignore but need a trusted answer with what to do...TIA

All the information you need on how to deal with this can be found in the sticky Announcement for NEWBIES that is on the main forum page where you clicked on the create new thread button.

Where did the alleged event occur because the laws in Scotland, NI, and England and Wales are different. I mention this because of your username?

What happened when you complained to the landowner/Costa/MSA manager, and your MP? That is always Plan A.

The advice to ignore has not been given on this forum since the law changed in 2012.

  • Lol...no, in Somerset,  my girl calls me this...I  haven't done anything yet as only received today. So is it best to contact Moto first?..it happened on the 11th November but only received  notice today. So I'm already out of time to appeal...

The keeper has 28 days from the issue date to appeal, so your maths is off.

From the date of event, the NTK must arrive by day 14 (the date of event being Day zero) for the keeper to be liable. If it arrived today, then it is not PoFA compliant and the keeper cannot be held liable.

All this is explained in the NEWBIES.

Appeal using the template in blue text from the NEWBIES, unaltered, from the keeper, save to add that: -
The NTK arrived too late for the keeper to be held liable, so they should cancel now or otherwise lose at PoPLA.

The most important is not to reveal the driver's identity.

Do enact Plan A first though, again without revealing the driver's identity.

If the driver didn't know they had to pay, the signs must have been inadequate and failed to bring the Ts and Cs (the contract) to the attention of the motorist.

  • I have contacted Moto, they can't/won't help..told me I have to appeal with Nexus.. and now I can't find the blue template. When I do, do I just email them it? Sorry I don't mean to sound stupid but I'm really stressing. I  did get the dates wrong, it happened on the 21st November,  I received letter on the 27th, so just 7 days...should send template immediately or wait for the 28 days?

You don't need fingers crossed. You realise the appeal won't work and isn't meant to?

You won't be winning any appeal but won't be paying either.

You need to read more of the NEWBIES thread because the stage when you win is court claim stage (the second post of the Announcement).
