Submitting Defence, 3 in 1 offences from Euro Parks using DCB Legal

  • Following up on this, i have just received a mediation appointment and gone through the threads on mediation. Mediation in the new DQ seems to be compulsory even if you do not complete a mediation form. I have seen others go through the same process.  It seems I have the following options.

Option 1 - No offer, happy to let the court decide on this
Option 2 - Offer a settlement figure of £5, case close.

Currently thinking of which one to decide on this. I am really learning a lot from this forum and enjoying the process.

Court is not involved in mediation; there is a mediation "expert" who talks to you and to the claimant or their solicitor.  Neither side can hear what the other side are saying.  You could offer £5 or £0.  Just do not accept high offers from the mediator and remember the mediator is supposed to be neutral!

I think for a multi-ticket case, you are likely to end up with a hearing (not a discontinuance), so maybe start with £30 (a tenner per PCN) and see.

Just my thoughts. If it is resolved for a 2 figure sum now, you might be satisfied with that, and I'm sure you check signs and avoid private car parks (like we do) nowadays and won't ever get more private PCNs, so even a few quid is a lose-lose for them.

Equally you could say 'see you in court' but be aware that does mean a likely hearing this time.  If your case is strong, go for it! Thing is, I cant tell what you ended up putting as the first few paragraphs of your defence in the end.

What did the first six paragraphs say?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I think a summary of my case.
Case 1 - Bought a ticket however overstayed for 30mins as i couldnt extend
    case 2 - Same
Case 3 - Stayed in car park for 11minutes as couldnt make payment on the app.

Comments acknowledge but my plan is to go with £5 offer for the two cases and the case 3 no. See where that leads me.

Providing an update on the case.

Mediation happend on 26th of Feb,2025

Case 1 - Offered £5 to a counter of £260, was later reduced to 150 and then eventually to £20. I increased mine to £10 however they refused so next stage is court.

Case 2 & 3 - Offfered same however i think they knew how it was going to go so they just proceeded to court.

Will keep you all posted on the court date.
  • Need advise, I have just had some new dates come up where I wont be able to make it in the court. I do not want to be given these dats for court appearance and not being able to show up because i will be out of the country.

What is the best way to submit these new dates to court? Is it just send an email and which email do i send to?

    Regards

    **** Providing an update **
Heard from the court and the good news is the date proposed works with me and also its just a telephone judgement so i do not need to be there physically.

    In regards to the case.

    Here are the updates.

Case 1 - Stayed in parking area for 11 minutes, court has struck it out as it explained that they do not have any case.

Case 2 - This was a three cases  in 1case, all had parking ticket and couldnt extend. Offered £10 and was accepted (so paid £30 in total)

Case 3 - This is the only case left, waiting for the court day which is the 8th of May.

thanks a alot @coupan-mad, your advise on the offering really helped.
