haven car insurance.

Back in june I was involved in a car crash after a pallet fell from a truck and I caught the back of the car that crashed into the pallet. I called my Insurence company and within 2 weeks they told me that as I was the rear car they were holding me liable and would not be contesting liability with the wagon drivers insurance and offered me 800 which clearly wouldn't get a replacement car. So I emailed the wagon drivers insurance company which the police supplied me with and within a week they accepted full liability. I'm still going through solicitors for the personal Injuries side of this but the same solicitors have said they couldn't represent me for the car damaged as I have already used my own Insurence company (I was initially after getting my 500 excess back which is why I initially called alianz (the wagon drivers insurance who I must say have been really nice and good) yesterday alianz told me that they have paid me out for the car damages to which I told them I haven't seen anything and asked who they paid out to. They told me they paid out in full to haven/acorn Insurence. So I asked if they could tell me how much they paid out. I was astounded. Now bare in mind my car was a 2008 Renault scenic grande automatic. Alianz paid them just over 35,000 of which they told me (they are giving me a full breakdown on Monday) 28,723 was for the car and the remaining 7,000 was for towing, storage and scrappage fees. 

Does anyone know if I'm within my rights to go back to haven and demand every penny over and above the 800 I have already received as a payment towards replacing my car. I understand they keep the rest as they paid the other fees. 

I'm carless and have been for 6 months due to the very low offer they gave me for my written off car.

    £35000 sounds more like the total of the claim but strange that they would tell you that kind of information 

    looking on auto trader £800 after excess does seem about right for the value of the car. Did you keep the car?

    You cannot claim again for the value of the car from Allianz. 
  • Yep they told me it was my fault and they would not pursue getting the money from alianz then as soon as they settled with me it seems they made a claim to alienz themselves clearly on a new for old basis . You were correct at reading alianz paid haven/acorn £35,000 of which £28,000 was just for replacing the car. Surely this is dishonest practice. I'm getting a full breakdown later today from alienz on what exactly each bit of the money they paid to haven and what it was for. I agree the extra £7000 is probably about right for the storage, recovery and scrappage of the car but to claim 28000 for my car while only giving me £800 seems extremely dishonest and I wonder how often this happens as most people once paid out don't follow up on this type of thing 
  • I'm not trying to claim again from alienz for the car although I was trying to get my excess and the items I lost in the car replaced. But now it seems that haven have claimed for a brand new car from alienz yet paid me a pittance in return.

    There is no way. Allianz have paid out the value of a new car
    they would have been supplied with a breakdown. All Allianz would pay back is what haven have paid out. 
    Those figures cannot be for your car alone. 

    You said there was another car involved. Do you  remember what type of car that was?

    Odds on they are talking about the total pay out to both parties.

  • Nope alianz told me on the phone that they have paid out. I asked who they paid it to and they told me they paid it to haven my Insurence company. The basic breakdown was as 28,000 for the car and 7000 for towing storage and scrappage. The wagon driver that dropped his pallets vehicle wasn't damaged. The car I hit only had the read driver corner damage gf ed and all I remember is he had just been and picked it up as a second hand vehicle. 

    Just looked it was a BMW with only 12,400 miles on the dash. This might explain it it was a 64 plate

    Your insurers can only recover what they paid out.  Forget new for old.

    Maybe they paid for the other car, and recovered what they paid out for it and what they paid you for yours.

    So you failed to leave sufficient gap and hit a vehicle after it did an emergency stop due to pallets falling of a vehicle? 

    Sounds like Allianz has mixed you up with the person that was hit by the unsafe load.
