Yep, use the new 'Regarding the POC' paragraph instead as para 3. Change the date. Job done!

Your defence certainly isn't going to be short.  What do you think the other 29 paragraphs cover? Don't show us the whole template defence but you are using it.

But in 2 change the word 'disclosed' to recalled.

There's a table in the opening post of the Template Defence thread which gives the CNBC email addresses.
Presumably the same table you used when filing a Defence.

Remember to send a copy to the Claimant of course.

Hi following the process in the newbie thread i`ve now been given a court date regarding the parking offence with euro parks.

I've looked at other WS and about to start compiling my own. My defence is that due to the time lapse of 2 years between the alleged offence and receiving the first correspondence advising a small claim. I Cannot be 100% sure regarding the driver at the time of the offence.

Other WS have submitted photographic evidence, i can attend the location and take images of the signage there now but i cant prove it was the same signage at the time of the alleged offence.

Does it matter that neither Euro parks or DCB legal have given me any photographic evidence of the offence? I only ask as during the mediation call i was asked by the mediator had i requested evidence? i hadn`t mentioned it, and found it a strange comment to make as if i should have requested evidence.

    Mediators don't have a clue!

Check your junk emails because this is the stage when DCB Legal discontinue.

    Process is as follows:

1.Login and file Acknowledgement of Service.
    2. Use defence template, changing paragraph 3 to your own personal circumstances. All in first person. Save as PDF and email to Northampton.
    3. Intimidation letter from DCB. Ignore.
    4. Look out for Allocation Questionnaire in post. DCB often send you one in the post too as an intimidation tactic. Complete and email to Northampton and DCB.
    5. Court allocation and mediation appointment letters.
    6. Mediation over telephone ("I'm not paying a penny, am not willing to make an offer and would like this to go to a hearing. Goodbye."
    7. Usually a discontinuation by DCB at this stage. If not, we're on to witness statements (come back for advice).
    8. Exchange of witness statements.
    9. Discontinuation by DCB.
Is this still the sequence of events?

Where it says all in first person I read somewhere here that you should do in third person, the defendant etc.

Also, any rough timelines or is it impossible. especially between 2 and 3 or 4.

Just in case I missed anything

Defence (which you've done) in third person.
    Witness statement in first person.

Euro will include photos in their WS if they bother submitting one.

If you go and take photos I would include a costs assessment at the end of your WS - 45p per mile and £19 per hour.

Euro could have included a copy of the contract they rely upon at any point since this all started. The onus is on them to make their claim. But it's too costly for them so they don't bother (amazing to think that somebody claiming money on the back of a contract can't be bothered to send you a copy at any point. Too many car parks, too much effort).

ANPR camera photos are a bit more automatic and they like including those because it scares people into paying.

Did you use the Chan and Akande cases in your Defence?  -  especially as you then go on to state in para 8 that

"The Claimant pursues a claim of non-payment....."  -  as also stated in your Defence.

Have not read any further than para 9 where you state "given that I never left the vehicle" then state "left when girlfriend entered the vehicle..."  -  which contradicts para 7 where you state you are unable to confirm who the driver was.

Have you copied and pasted another posters WS?
