I was sure I HAD seen it was a tactic used... thanks @Coupon-mad
Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire and the usual intimidating template letter saying they 'intend to proceed'. Nothing of interest there. Just file it. YOU MAY HAVE TO WAIT TWO MONTHS OR SO FOR THE NEXT STEP TO HAPPEN:
(for the searchers that stumble upon this question here it's currently item 7 in the list... )

My official copy of the directions questionnaire arrived today from the Civil National Business Centre. Per the thread I've completed and mailed back a correct directions questionnaire:
    • to DQ.CNBC@justice.gov.uk (from the court finder page); and
    • copied in info@dcblegal.co.uk (on the letterhead from DCB Legal that accompanied their DQ)
    Now to wait until spring.

Mediation completed. No deal was struck (of course) now to wait until it's referred to the court.
  • When parking rules are (mis)explained by staff at the venue - is there any case law that you fine folks know of that shows that it's reasonable for the person parking there to assume that their advise is correct, and that indicates that they are acting on PE's behalf in some way?
  • Hey folks, I'm working on my WS based off the excellent example that @imulsion set. Are those Exhibit 03 photos available in something other than the PDF @imulsion posted? I'd like to include them in my WS too.

@Coupon-mad have you seen my question about the legal standing of parking advice given by the employees of the place you parked at. Has there been any case law that you are aware of that might point to that over-ruling the text actually printed on signs?

@Coupon-mad I know I have a lot of questions at this stage... but I am writing the WS. Should I be including Excel v Wilkinson? The Claim has:

    1. £680 being the total of the PCN(s) and damages.
    2. Interest at a rate of 8% per annum pursuant to s.69 of the County Courts Act 1984 from the date hereof at a daily rate of £.13 until judgment or sooner payment.
    3. Costs and court fees

    Amount claimed 820.16
    Court fee 70.00
    Legal representative's costs 70.00
    Total amount 960.16

    So... yes? I think?

Hi, new here but have been following the different threads for a while. Currently at the stage of writing a defence and have just uploaded my thread on this. Submitted my AoS today. Will be following your thread for defence ideas and to see how your case goes. All the best with it 👍🏼

Yep, that's a verbal contract.  You were entitled to rely upon it.

And everyone includes Excel v Wilkinson, hence why it is on the a-f list of exhibits in the NEWBIES thread.

Thanks @Coupon-mad I thought as much!

I have a first draft of my (anonymised) WS ready for review and your thoughts now: https://drive.google.com/file/d/1rU3m7glKHXNcaBDCabFdFu9YsVtxwq60/view

I'd remove 35 and 38 in an effort to shorten it.

And only use Chan and Akande to attack the POC, remove all the multiple strike outs as you need the WS to get under 50 pages.
