Overwhelmed - just discovered PCN CCJ and paid removal services

Options
Hello all,

I've gone through the newbies thread and spent hours reading recommended posts and whilst the advice and support is amazing, I feel totally overwhelmed and out of my depth!

I've just discovered I have a CCJ on my record for a £300ish dated Feb 2022. I've gone through Trust Online and then the Civil National Business Centre to discover it is for a parking charge from Highview Parking LTD who were represented by DCB Legal. I have been at the same address for 10+ years, but have received no notice of this parking charge nor the CCJ that has been filed due to it. The record from CNBC states on the particulars that I agreed to pay the charge in 28 days and did not - I did not agree to this as I was not notified! The PCN is for parking on private land in 2019, which I have no recollection of but given it was 5 years ago it could have happened. I was not the only insured driver of the vehicle at that time, and no longer own the vehicle as of 2022.

I can't work out from the advice on the forums what my next step should be - the issue isn't that I've moved I've just simply not received the PCN that the company claim nor anything about a CCJ. Given how lost and overwhelmed I feel despite all of the amazing advice on offer, would I be best using a company like CCJ Removal Services or similar? I know there's a cost to that which is probably similar to just paying the disputed amount, but I just want this removed from my file the easiest way possible!

Thank you so much for taking the time to read this! I'd appreciate any advice.

Well paying it won't remove it from your credit record, only a set aside can do what you want

There is a set aside option called "with consent" where you pay around £108 plus everything else ( usually. ) but you need the joint agreement of Group Nexus

The alternative is a contested set aside for £303 , if you have good grounds for it, like paperwork going to an old address for example, but you said that no paperwork arrived. That is strange because numerous letters would have been sent to the address of the RK, the one on the V5c and on the DVLA database
  • Thank you for your advice @Gr1pr . I don't know why I've not received any letters, and being able to prove that I didn't is obviously impossible so I'm not sure it will be accepted as good grounds for a contested set aside. There's no reason for me to have not received anything when I've been at the same address for so long so I cannot explain it. Had I received anything I would have contested the PCN at the time using the guidance on MSE which makes it additionally frustrating!

I'm happy to pay if it just gets it removed, whether I think the charge is fair or not it's doing far more damage and will end up costing me more in the long run. I'll look up a set aside with consent as you've advised, thank you.
  • Are you sure that the address on your vehicle's V5C document (NOT your licence address) is the current address you have resided at?
If so, double check that it is exactly as your address should be without typos mispellings, missing numerals or letters.  If no issues with the points above, is your address known to have postal delivery issues?

You may also want to request from the DVLA any details of requests made by private parking companies within the time period of the PCN in 2019.

The address is all correct on the V5C, and I've not experienced issues with not receiving post before (at least not to my knowledge - I wouldn't have said I'd ever had an issue before this!).

Thank you for the recommendation, that's a great idea - I'll contact DVLA to find that out.

Why are you overwhelmed?   Getting a CCJ removed is hardly quantum psychics, and the process is all explained here
This comment seems unnecessary and belittling - I don't owe an explanation as to my personal circumstances which may mean suddenly having to deal with this issue is causing me anxiety or concern. I've tried to find the answer for myself using the forum, and I'm well aware that not being able to do so is a reflection on me rather than the excellent advice that has been provided. As I have no way to prove or explain why I've not received any letters I'm uncertain as to how I should proceed and so greatly appreciate those who have responded with advice and kindness.

Is that CCJ Removals? They seem quite upstanding from the research I've done but insight from real people is appreciated thank you! I wonder if for peace of mind whether just going through them is my best way forward.

It's pretty much impossible for 8 or 9 letters not to arrive. As they will all have the same address on them it would suggest there was a typo.

Definitely contact the DVLA to obtain details of when your data was Accessed, plus get them to confirm the exact details given at the time regarding the Registered Keeper name and especially the address. Umkomaas regularly posts the contact details for the DVLA database check online query, but the reply comes in the post

I suggest that you email a SAR to the DPO at Group Nexus with proof such as 2 recent redacted copies of utility bills, plus add the VRM details too, in order to obtain all your data, including copies of all paperwork and pictures and the court claim etc

I would suggest that you do the same thing with the DPO at DCB Legal too

I would also use the CCJ reference to check the details with the CNBC in Northampton as well, see where the N1SDT claim form and the subsequent CCJ letter went and when

Those myriad letters went somewhere , paperwork is part of the solution here

That's amazing, thank you so much. I'll start to follow those steps now to start to unpick what has happened and hopefully, that will make it clearer how I should proceed. Thank you for taking the time to make those suggestions, I really appreciate it.
