Speeding Ticket - 41 in a 30 - No history of speeding tickets
Hi, I hope you're well
I just got a letter in for a speeding ticket that says I was doing 41mph in a 30mph zone on 12/11/24 - automatic camera device, It was dated 14/11/24 but I only received it today
I have never had a speeding ticket before, I don't have any points on my license or otherwise, and I am not a "new driver" (as per the definition) either
I have been going down this route for the past 2 years and I have never had this happen before, so I am not sure how fast I was going to be honest, and unfortunately, I don't have a dash cam fitted (lesson learned I guess) -
There is a part of the road that is 40 and a part that is 30, I guess I misjudged which I was driving in at the time (if I was going that fast, but don't remember)
I just wanted guidance on what is done, and what can (possibly) happen
I have read online this is in the Band B zone (just) and that requires 'court' ?
What about the 10% +2 rule, is that a thing, this would bring it down to 38.9mph
Thanks

The 10% +2 is just the level above the posted limit at which most police forces start taking action, it’s not an adjustment factor. For a 30mph limit you should be offered a Speed Awareness Course for upto 42mph, so you should avoid any points on your license if you return your details, pay the fee and take the course.2

You misunderstand, the 10%+2 "rule" determines the threshold where enforcement starts, to for 30 MPH limit this is 30+3+2, i.e. 35 MPH. Your speed is assumed to be correct, so above the limit for enforcement. The good news is that in a 30 MPH limit, speed below 50 will see a fixed penalty of 3 points and £100 fine offered (assuming you are not currently on 9 points or more, which you are not). The even better news is that for speeds of 42 or lower a speed awareness course should be offered (unless the offence was committed in Scotland) which is roughly the same cost of the fixed penalty fine but does not attract any points.
So at this point all you are being required to do is name yourself as the driver at the time of the offence. The only other thing of note is why it has taken over a month for the notice to reach you, is this perhaps a leased vehicle and you are not the Registered Keeper?1 -
You were doing 10% + 8, so hopefully you will be offered a speeding awareness course. If so, take it.
I am actually much more aware of the limit and what speed I am doing, since I took the course.1 -

I just wanted guidance on what is done, and what can (possibly) happenAbsolute worst case scenario - £100 fine and 3 points. No big deal in the grand scheme of things, to be honest. Assuming you've got a clean licence, then 3 points may mean that your insurance premiums will increase ever so slightly. Depending on the insurer, it's possible you won't see an increase at all.But don't go fretting unnecessarily - as I say, even the worst-case scenario is no big deal really.

Get it returned ASAP so as to maximise the liklihood of being offered a course.
Keep a copy of your reply and send it back first class*. Post it from a Post Office counter and get a certificate of proof of posting.
In your reply just name yourself unequivocally. Don't add anything that might make it look as if you are unsure who was driving or might make it look like you don't think you were speeding. If you do they won't offer a course.
I did a course last year and it was straightforward. No criticism or looking down at you. It was quite informative. Where I live all courses are online and take up no more than two or three hours with about 6 participants.
*Most constabularies insist that you send the paper form back snailmail if you are naming yourself rather than someone else. Where I live (Norfolk & Suffolk) they actually allow you to name yourself online and you get an immediate acknowledgement. Better than risking it getting lost in the mail. Check your NIP/s172 request to see how you have to reply2 -
Hi guys, thanks for all the advice
As it stands, I have responded to their notice as per the advice of yourselves via their online portal - they wrote down the link with the notice no. and the passcode to respond to the case
However, I will say, although I responded to the notice on their online portal I didn't receive an acknowledgement email stating the submission was received
I tried to login again but it said the details were incorrect?
I inputted the details a few times, EXACTLY as stated in the letter and just like I did the first time when I submitted the response (which was literally about 5 minutes before) and now it has locked me out
I have sent an email to the police telling them I have submitted the notice with the notice reference and also telling them the portal has locked me out so I can't go back into it
Just in case it was a glitch in the system and they really didn't receive it -
Do we always receive acknowledgment emails, or do we just wait it out?
P.S. I admitted responsibility in the response, and that I am the registered owner of the vehicle0 -
@MFR123
The usual experience on here and on other traffic forums is that most constabularies will not allow you to nominate yourself online as the driver although they will allow you to name another person online as the driver.
Norfolk & suffolk is one of the few that will allow you to nominate yourself online as the driver.
Are you certain your NIP/s172 request allows you to nominate yourself online and that they don't require a signed paper nomination?
(If it comes to a prosecution for speeding the police need the identity of the driver. The only evidence they will have of the driver's identity is the driver's nomination of themself. The majority of police forces seem to doubt whether an online e-signed nomination would be admissible in court.)0
