price hike in contract and still billed after cancelation

im unsure of my rights 

I have been with a company who's app i used for members of my gym to use to sign into classes

they put there prices up, trebled in fact per quarter, because they had been bought over by a new company

i got an email, which i did not see giving me 4 weeks notice regarding this, i opted out as it was too dear, they said i was 5 days out of the notification period (30 days) 

and they billed me for the next 3 months

two things the email i received went to my junk as along with other emails as and some emails made it through to my inbox 

where do i stand ive explained this and there are saying im out of my period, and that's that im not getting a refund 

also i think i was not getting the email because the name had changed from the company and my email classed it as junk where as the original company named emails came directly to my inbox

    What tools you use for your email and to determine if mail is junk or not is ultimately your choice and therefore your consequences to deal with if they are over zealous etc. 

    You need to go back and read the terms and conditions you agreed to, almost certainly it will have clauses about price changing and potentially a right to cancel if the increase is more than X% and a time limit. If it is 30 days and you notified them after 30 days then they are doing nothing wrong and you should look at your broader cancellation rights in the same terms which could well have a minimum contract duration. 

    They dont have to give you more time just because you've got your junk filter set such as their emails are trapped. 
  • As it's to do with your Gym it's a B2B so consumer law doesn't apply. What does your contract state about price increases?
