Uninsured Vehicle

I traded in an old car for a new one with Sytner Mercedes - they took away the old car, V5 and keys etc in July saying they would deal with the return of my old vehicle (Merc Ben Finance Lease) when they delivered the new car.
In Oct DVLA contact me and charge me £100 for having an uninsured vehicle (my old car) I sent them proof I had returned the Car to the Dealer etc via their "appeal" process and have offered to reduce the fine to £50 as they were not aware until my appeal that I was not the owner of the vehicle ?!?
Surely I cant be liable for any "fine" if I prove the car was returned to the Dealer - DVLAs issue should be with the Dealership not me ?!
If this were not true a Dealer could stitch anyone up by not sending in the V5 - and lets not even get started about how many items of post go missing daily in this country !?
Any suggestions ?

you would have needed to contact dvla and update to say you were not the keeper
if they have agreed to reduce it. take that and be aware for next time1 -

Certainly some dealers offer to deal with part 4 for you but its your legal obligation and so if they forget to do it or otherwise mess up you've no one to blame but yourself for not following the instructions on the V5c.1 -
What you need to prove to them is not that the car was returned to the dealer, but that you are no longer the Registered Keeper.
Informing the DVLA of that is the seller's responsibility. Although you have given your consent for the dealer to do that on your behalf, it remains your responsibility and you are on the hook if anything goes wrong. If you sell the vehicle to a dealer you should have kept the appropriate part of the V5C before giving the rest to them, and sent it to the DVLA yourself. You can do all this online now and get an instant acknowledgement.
Whoever does the transfer, you should have received an acknowledgement of the it from the DVLA and you should also have received a refund of any VED still remaining.
If I were you I'd grab the offer of a reduced penalty and approach the dealer to ask them if they'd consider helping you out a little with it since this seems to be their oversight.2 -
This is why you should do it online at time of exchange. Email confirmation from DVLA & no issues if they do something stupid.
But given you have bought a new car via them. Go to the dealers to speak to the manager about the issue. If they do not sort it there & then Contact the CEO of the group..Life in the slow lane0
