Samsung tv

My 3 year old samsung tv has broken down
bought directly from Samsung.
they wished me to pay for a repair as warranty expired  but I think it's not fit for purpose Mother board defective)  under consumer  credit act.
after many emails they agreed to replace tv like for like, as part no longer availably. However now have decided they have found part required to fix this and ordered a repair, and expected me to pay without even consulting me. 
I esculated dispute to ceo and they have come back to me today offering to pay for parts but I have to pay labour cost.
I have also put claim in to credit card company under section 75. 
I'm not sure how I stand with consumer  credit act if a repair is feasible?  but don't see why I should pay to make item fit for purpose

    I think you mean Consumer Rights Act 2015?

    Also, I think you mean faulty rather than fit for purpose. 

    Anyway, as you’ve had the TV more than six months you’ll need to prove that the TV is inherently faulty or not of sufficient quality. As opposed to not working because of misuse/abuse/accident. 

    If you can do that then Samsung should repair the TV or offer a partial refund reduced to take account of the use you’ve had of it.

    Both the Consumer Rights Act 2015 and the Consumer Credit Act 1974 can be in play here.

    It's the former that requires that goods are of satisfactory quality, durability, etc.

    The latter (and its section 75 in particular) establishes the principle of joint liability, allowing the consumer to pursue the creditor instead of the merchant when seeking to enforce rights granted under CRA.
  • Hi thank you for the responses, yes I meant consumer rights act . Tv been assessed and stated on the report that mother board defective. yes they agreed to repair but at my expense. 
    The last response referred me back to retailer despite several emails and invoice showing they are retailer. they gave me a phone number to call  for shop department after speaking to 3 diffrent people in 3 departments I was sent back to product support.
    I guess my question is should I expect  Samsung to repair tv free of charge as defective mother board under consumer rights act ? even if it is out of warranty

    Generally yes*, you have the right to a repair.

    A failed motherboard is likely to be a durability issue but I guess other things could affect this (TV being near a heat source? I don't know), if Samsung accept it's a "fault" rather than misuse/etc then that's great, if you need to go to small claims to enforce your rights then it's hard to say what a court would decide where a report says failed motherboard but not why it's failed.

    *Just worth a note here that I think it was the Samsung website that was run by another company, best to check the full terms to ensure the contract for supplying the TV was actually with Samsung.
