Stamp duty on new home after separation

Grateful for any enlightenment. :)

Married 2000.Left family home 2014 as we were not getting on too well.Spouse continues to live in property which is fully owned by us(no mortgage) as joint tenants.No children in this picture.

From 2014 to present I have lived solely  at my mother's home with her. Unfortunately she died earlier this year and the house is to be sold.

I will now be purchasing a smaller property for myself and I was wondering what my position is regarding stamp duty.
Also, are there CGT implications  if I was to transfer ownership of the original home to separated spouse?...or she bought out my interest in the house?

We are unlikely to be getting divorced for reasons outside this discussion.

  • You need to divorce and get a clean break.  Financially, you may be stung for 2nd home Stamp Duty.  You need to divorce, split the assets and move on.  You might be separated, but you're most definitely still in business together.
