NCP and TRACE Debt Recovery

I recently had three separate penalty notices from NCP relating to non-payment of drop off fees at Gatwick Airport. These arose because I had failed to correctly record my new car registration, a mistake that's now rectified. On all three occasions the car was not driven by me and I successfully appealed the last two. This was thanks to the helpful advice from MSE Forum for which I am very grateful. Unfortunately, for the first appeal I mistakenly entered that I was the driver (I genuinely wasn't) and when the appeal was adjudicated by POCA they found in favour of NCP as they did not believe my assertion that I wasn't. POCA said I should pay the £100 penalty, but I waited to see what NCP would do and have now received a text from TRACE Debt Recovery asking me to contact them at paytdr.co.uk . I have not made contact yet and would appreciate any advice on what I should now do. No doubt TRACE will be seeking £100 plus whatever costs they assess.
As a matter of interest, can I challenge them to produce a photo of the drop off showing that I was not the driver.
My thanks in anticipation.

Come back when you get a LBC from a solicitor.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Having ignored Trace, I have now received the attached letter from Moorside chasing the penalty of £170 and stating that they may be instructed to issue a County Court Claim. I would be very grateful for any advice on what I should do now.0

You don't owe £170 that figure includes a debt collection add on which you haven't incurred it's still just a begging letter which can be ignored though note the statement "we MAY be instructed to start legal proceedings".

That looks like a debt collector letter dressed up as a Letter of/before Claim, in other words a) another frightener and b) to be ignored. Wait for a proper LOC and then check the correct response in the NEWBIE second post.2

Sit tight. Do nothing except the below.
By going confidently into the 'ignore' stance, the only steps to take (because you MUST check every letter) are:
- Tell them if you move house within 6 years.
- Ignore the tedious £170 threatograms shown in pictures in the 4th post of the NEWBIES thread.
- Come back if you get a solicitor's LBC as per the 2nd post of the NEWBIES thread.
Nobody pays a penny and no hearing is even needed in most cases. Search the forum and read a few cases as they are easy to beat by waiting for a claim form - it is easier than appealing!
There is no risk AT ALL in defending a court claim. No CCJ. No bailiffs.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have now received a Letter of Claim from Moorside dated 3rd March saying I have 30 days to respond or they will issue a County Court Claim. I have been abroad, hence why I have not acted sooner. I propose disputing the debt and setting out the reasons on a separate sheet of paper. My main defence is that I was not the driver and that two later incidents were cancelled by NCP where the circumstances were exactly the same. The only chink in my defence is that I ticked the box saying I was the driver when I meant to tick owner.
I would appreciate any views that might bolster my position.0 -
Your future defence will be based around the template defence and all the other Moorside claims already in motion on here
Not being the driver is no defence, nor previous cancellations
Your defence will be based on countering the POC listed in the future claim form, which nobody has seen yet, but will likely be similar to all the other recent claims
If you are going to respond to Moorside, use the template response in post 2 in the newbies sticky thread, no changes, and email it to Moorside Legal. No paperwork is involved, no form filling, just an email2
