Britannia parking fine

I received a fine for overstaying by 20 minutes for an hour. I appealed, stating that I left at the correct time and left to look for more spaces and left again. They still want me to pay the fine and has sent me 'final warning'. Please help! I have read the newbie posts - I am unsure if I will be able to claim  that I was not the driver as I said I.... I am a student I really cant afford this! Any help is much appreciated

But you don't have a fine.

I appealed, stating that I left at the correct time and left to look for more spaces and left again.
    Was that true?

I'm not sure what you mean by saying I don't have a fine.... I wish!
It unfortunately was not true though, no. I thought it was my best response for the time.

What Couponmad means is that it's not a fine but actually an invoice.  An invoice assumes there is a contract between you and the company that overseas the parking at that location.

If you read the stickies on the parking forum you'll see that the first thing to do is to go and talk to the company/shop that you were visiting when you parked there.  If it's, for instance, a Tesco go in and talk to the customer service desk and ask that the manager request the invoice be cancelled.  If you get a flat no on that then go back to the stickies and see what plan B is.

Some people say you should complain to your MP (for that area if you are from elsewhere) and others might say do nothing until you get the really nasty letters that say they are taking you to court because you haven't paid whatever they have inflated the amount to.  The tricky part if you are a student is if you move during the time it takes to get to this point - which might be a couple of years.  If you do move you'll need to update the parking company with your address and tell them to delete any previous address you have.  Easy to remember to do this as you'll be updating DVLA at the same time of course.

Magistrates issue fines, this has never been there and never will

Britannia issue private Parking Charge Notices, invoices , nothing more, so that's what you received

This is a civil matter.  There is no criminality, just a scammer alleging that you broke a contract,  (did you) and they want compensation for the damage they suffered

They can take you to court where a judge will decide whether  their claim has any merit.  If he thinks it does he can order you to pay them an  amount, usually about half of  what they are claiming.  If you do not pay the judgemant you may get a CCJ against you.
You never know how far you can go until you go too far.

I've no idea why you think a private parking charge is a fine, even after being advised that it's not. The piece of bog-paper you received does not tell you it is a fine or penalty. Please read the NEWBIES FAQS thread.

No link needed. You have two on this page.

  • Apologies! I did think I scoured the newbies thread vigilantly but it doesnt specify what should be done if I specified (wrongfully) that I was the named driver. Am I now waiting for them to take me to court? Is this wise? Thanks so much for the help

Yes that is the wise advice. We know what we're doing. Tell them if you move house.

I don't need to specify every scenario in the NEWBIES thread. Just stages and your stage is in the fourth post. Ignore the debt crawlers.

    That is all.
