A CHANCE TO WIN A VIRGIN VOYAGES CRUISE FOR TWO ADULTS 

Conditions of entry

1.    This prize draw (the "Promotion") is only open to legal residents of The United Kingdom. Any employees or agents of either the Promoter, the Prize Administrator, and/or any company connected with the production or distribution of this Promotion, as well as any members of their immediate family (e.g., spouse, parent, child, sibling) and persons living in the same household as them, whether or not related, are not eligible to enter this Promotion. Persons under the age of 18 are not eligible to enter this Promotion.

2. Entrants must be aged 18 years or over at the time of entry. Proof of eligibility must be provided upon request.  By entering the Promotion you are deemed to accept and be bound by these terms and conditions.

3. Enter between 00:01 GMT on Saturday, November 16, 2024 to 23:59 GMT Sunday, November 24, 2024, inclusive (“Promotion Period”).

4. The Promotion is free to enter, however internet access is required. Entrants can enter by visiting www.mailplus.co.uk/virginvoyages and entering their name, date of birth, contact number and email address.  Only one (1) entry will be accepted per person or email address. Winner

5.    There will be TWENTY (20) winners who will be selected in a random draw, conducted by a computer process that produces verifiably random results, from all eligible entries, held on Monday, November 25, 2024.

6.    The winners will be notified by the Prize Administrator by email within one week of this date and will be given details of how to accept their prize.  Reasonable efforts will be made to contact the provisional winners, but it is each winner’s responsibility to monitor their email address (including spam folder).Failure by the winners to accept the prize in the manner specified within one week of the Prize Administrator's email will make any claim invalid and the Prize Administrator will then select another winner (again selected randomly in a draw) from all remaining eligible entries who will be contacted as above.

7.    The prize is for one (1) access key for Virgin Voyages’ sailings departing from Miami, San Juan, Barcelona or Athens, sailing between 1 September 2024 and 31 August 2025, for 7 nights or less.

8.    Access Keys are issued and must be used in accordance with the following terms and conditions:

-    Access Keys are for new bookings only. Prize consists of one (1) unique access key redeemable for one (1) double occupancy “The Sea Terrace” cabin for the Winner and one (1) guest on the specified Virgin Voyages’ sailing as described in Section 7 above. 

-    The Access Key is to be booked via the Virgin Voyages’ website only 

-    The Winner must redeem the access key and book their voyage before 31 March 2025. Failure to redeem the access key on or before 31 March 2025 will result in forfeiture of the prize. Except for the Resilient Lady sailing from San Juan, which may occur in 2024, all travel must start and end in 2025.

-    Access Keys: (a) provide a 100% off Voyage Fare discount off the original fare (before any discounts) including taxes and excludes all upgrades, voyage protection, transfers (unless in a Suite), and any applicable fuel surcharges; (b) be double occupancy only; (c) be solely for voyage redemption; and (d) not be combined with any other discounts, special offers, nor promotions, except as provided herein.

-    Access Keys may be limited to a specified itinerary and stateroom category. Access Key holders are eligible to bid for a cabin upgrade when Virgin Voyages’ “Level Upgrade” program is activated from time to time. Customers eligible for Level Upgrade will automatically receive an email inviting them to bid for a cabin upgrade in accordance with the terms and conditions of the Level Upgrade offer.

-    The Holder of this Access Key must be eighteen (18) years of age or older at the time of booking and the Holder and any additional guest(s) must satisfy Virgin Voyages’ additional requirements for passage as set forth in the Virgin Voyages Additional Terms and Conditions at https://www.virginvoyages.com/Web-Marketing/addl-terms-and-conditions.html.

-    This Access Key is nonrefundable, nontransferable and not replaceable. It has no cash value and is not redeemable for cash. The Access Key is void if sold for cash or other consideration. Disclosure to Sailors that one is travelling on an Access Key is not permitted, and doing so violates these Terms and Conditions.

-    Should any Access Key recipient wish to add a 3rd or 4th Sailor to their cabin, applicable 3rd and 4th Sailor voyage fares will apply as well as additional taxes & fees.

-    Access Keys may not be used and are not applicable for charters; nor may they be used for customised Circle programs (i.e., value add Circle).

-    Any tax liability, including disclosure, connected with the receipt or use of this Access Key is the recipient’s sole responsibility and liability.

-    Persons sailing on an Access Key, like any other passenger, are expected to adhere to the Virgin Voyages Sailor Conduct Policy, located here: https://www.virginvoyages.com/safety-security/sailor-conduct-policy. Selling or bartering of an Access Key, or offering an Access Key in exchange for any consideration, is strictly prohibited.

-    Virgin Voyages will evaluate instances of apparent or suspected violation of these Access Key Terms and Conditions, and shall do so in its sole discretion. Persons may be subject to action up to and including permanent barment from Virgin Voyages’ vessels for misuse of an Access Key. Employees of external affiliate companies, or contractors or anyone not directly employed by Virgin Voyages may be subject to action up to and including permanent barment from Virgin Voyages’ vessels.

-    Virgin Voyages reserves the right to substitute ports, change itineraries or substitute vessels on all itineraries as more specifically provided in the Virgin Voyages Ticket Agreement, available at https://www.virginvoyages.com/Web-Marketing/addl- terms-and-conditions.html (click on the appropriate Ticket Contract link). The provisions of Virgin Voyages Additional Terms and Conditions, also available online at https://www.virginvoyages.com/Web-Marketing/addl-terms-and-conditions.html, are hereby incorporated by reference. Among other points within these Terms and Conditions, any dispute resolution between you and Virgin Voyages must take place in Miami or London, depending on your principal residence at time of booking, and must be filed within a certain period of time. By redeeming an Access Key, the recipient agrees to be bound by all such terms and conditions. Virgin Voyages reserves the right to modify these terms at its discretion with or without notice.

-    All Sailors are expected to conduct themselves in a civilised and courteous manner. The Captain and his/her designees have the authority and responsibility to enforce Virgin Voyages Sailor Conduct policy. 9.    For the avoidance of doubt, the Prize does not include travel/transportation, travel insurance, travel documentation, accommodation off the ship, activities, excursions, food, beverages, souvenirs, gratuities, car parking charges, or any other costs of a personal nature (including spending money) that are not explicitly set out in these Terms and Conditions and neither the Promoter, Prize Administrator, nor any provider of any part of the Prize will be responsible for any such costs.

10.    Gifts, prizes and other promotional items are not transferable, may not be re-sold and are subject to availability. The Promoter reserves the right in their reasonable discretion to substitute any such gift, prize or item with a gift, prize or item of equal value.

11.    By entering the Promotion, each entrant acknowledges that in the event of a win, their name and county of residence may be disclosed to persons enquiring, where permitted by law. Provided no objection is received from the winners, a winners list will be made available by the Prize Administrator four (4) weeks after the end of the Promotion Period, for a period of 8 weeks. Without prejudice, the Prize Administrator will provide winner information to the Advertising Standards Authority when requested by them.

12.    Entrants agree to provide reasonable cooperation to allow the Promoter and the Prize Administrator to use the name and/or likeness of the winner for advertising and publicity purposes in connection with this Promotion including but not limited to publication of the winner's name and photograph on the Promoter and the Prize Administrator’s websites.  In addition, by submitting an entry and in consideration of the Promoter and the Prize Administrator granting a right to enter the Promotion, entrants agree to grant the Promoter and the Prize Administrator a perpetual, royalty-free, non-exclusive, sub-licensable right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and exercise all copyright and publicity rights with respect to any materials contained in the entry (including but not limited to text, images or video materials) (the “Materials”) worldwide and/or to incorporate the Materials in other works in any media now known or later developed for the full term of any rights that may exist in the Materials. By submitting Materials to the competition, an entrant:

a.    warrants that the Materials are its own original work and that it has the right to make them available for all the purposes specified above; that it does not infringe any law; that it is not obscene or libellous; and that it does not violate the rights of any third party; 

b.    agrees to indemnify each of the Promoter and the Prize Administrator against all legal fees, damages and other expenses that may be incurred as a result of a breach of the above warranty; 

c.    agrees to waive any moral rights in the Materials for the purposes of its submission to, and publication by, the Promoter and/or the Prize Administrator the purposes specified above.

13.    Any personal information provided to the Prize Administrator during the entry process (including but not limited to your name, e-mail address, telephone number and date of birth) must be correct. The Prize Administrator accepts no responsibility for any incorrect personal information provided.

15.    The Prize Administrator will only share your personal information with the Promoter where you are the winner of the Promotion or where you have opted in to receive direct marketing from the Promoter (if relevant). The Promoter will hold your personal information as a separate controller in accordance with its privacy policy (available here: https://www.virginvoyages.com/privacy-notice) and shall implement and maintain appropriate technical and organisational security measures in compliance with the GDPR and any other applicable law.

General

16.    The determination and decision of the Promoter on all matters shall be final and no promotional correspondence or discussion will be entered into. 

17.    The Promoter and the Prize Administrator reserve the right in their reasonable discretion: 

a.    to disqualify any claimant, competitor or nominee whose conduct is contrary to the spirit of the rules or the intention of the promotion and to declare as void any or all of their claims or entries based on such conduct; 

b.    to declare as void any claims or entries resulting from any printing, production and/or distribution errors (including but not limited to any error(s) on any website of the Promoter or the Prize Administrator, any game cards and/or other printed materials) or where there has been error(s) in any aspect of the preparation for or conduct of the promotion materially affecting the result of the promotion or the number of claimants or the value of claims; 

c.    to add to or to waive any rules on reasonable notice; and/or 

d.    to cancel the promotion or any part of it at any stage in the event of circumstances beyond the Promoter's or the Prize Administrator’s reasonable control.

18.    No entries will be accepted in bulk, from agents or third parties.

19.    To the fullest extent permitted by law (and subject to paragraph 21 below), the Promoter and the Prize Administrator hereby excludes all warranties, representations, covenants and liabilities (whether express or implied) relating to this Promotion and/or the prize.

20.    The Promotion is in no way sponsored, endorsed, administered by or associated with any social media platform or any other third party. All third-party trademarks and other intellectual property rights are hereby acknowledged. Use of and entry to promotions via social media platforms is always subject to the rules, terms and policies of those platforms. By participating in the Promotion, entrants are providing information to the Promoter, not to any relevant social media platform. To the maximum extent permitted by applicable law, the relevant social media platforms shall have no liability to any person in connection with or arising out of the Promotion howsoever caused, including for any costs, expenses, damages, and other liabilities.

21.    Nothing in these terms and conditions shall exclude the Promoter's liability for: 

(i)    death or personal injury as a result of its negligence; 

(ii)    fraud or fraudulent misrepresentation; or 

(iii)   any liability that cannot be limited or excluded by law.

22.    The Promoter and the Prize Administrator reserve the right, in their sole discretion, to modify, suspend or cancel the Promotion should virus, bugs, tampering, fraud or other causes beyond the reasonable control of the Promoter or the Prize Administrator corrupt or hinder the administration, security or proper play of the Promotion.

23.    If any of the provisions of these terms and conditions are held to be invalid or unenforceable in whole or in part that part shall be severed from the remainder of the provisions and the validity of the other provisions and the remainder of the provision in question shall not be affected.

24.    These terms and conditions shall be governed by the laws of England and any dispute shall be subject to the exclusive jurisdiction of the English courts.
