Lost car

We bought a used BMWX5 from BMW Leicester garage in March this year, it went into another BMW garage Warwick 2 weeks ago for a recall and a service.  6 days later we breakdown on the  motorway and the feedback from the garage is that it needs a total new engine !!. BMW are saying the warranty doesn't cover it and so you get nothing.  We basically walk away in less than 8 months of giving them £30K.  It's funny that there was nothing wrong, it has a service and 6 days later it breaks down and their is blue liquid all over the under bonnet like someone did not put the liquid on properly.   As this is so soon after purchasing the car, I am saying the the product is not fit for purpose, otherwise, they can sell any old rubbish for top wack, and know it's not going to last.  Please let me know your thoughts?

    What do they say the actual issue is/was?  This will be crucial in determining whether it was (or should have been) foreseeable at the time of sale - if you're looking to pursue the seller under consumer rights more than six months after sale, the onus is on you to demonstrate that the issue was present at the time, e.g. a manufacturing flaw.

    Or if you wish to challenge whether it's covered by warranty then you'd need to validate whether there's any truth in their assertion that it's out of scope, by reference to the terms.

    How old is it?

    What was the recall for?

    What is the diagnosis for the engine failure?

    Did it come with a warranty?

    Who provided the warranty if applicable?

    I suspect it's around 6 years old ? Possibly older ?

    I would expect you can get a used engine fitted for a lot less than £30K, it feels you had it too long to claim from the dealer, too old to claim from BMW.

    I'd not take their word for it on the warranty get the details look at carefully.

    So going to be 8 years old at a guess?
    Which engine?
    Mileage?

    Blue liquid guess coolant. So even if cap left off, it would not spray everywhere as that would be on expansion bottle. So more likely to be head gasket blowing big style.

    You've had it for over 6 months and so its up to you prove the issue was present at point of sale or that it is unreasonable given the overall age the vehicle. This would normally be accomplished by paying for an independent engineer to inspect the vehicle but if the merchant has had time with the vehicle since your breakdown they may have cleaned up the "blue liquid" or adjusted caps etc just as part of their review (rather than implying something underhanded) so a smoking gun may be less evident. 

    £30k is presumably for BMW to do it with a brand new motor? There are potentially other less expensive routes available as clearly the rest of the vehicle isn't brand new either.

    £30K was the purchase cost, not the repair estimate:

    The car is 2017
    The recall was for driver airbag
    We don't know we have to authorise that
    It did come with a 3 year warranty, but only up to £5K per claim
    Sytner select provided the 3 yr warranty

    Did they say that it just doesn't cover (or partially cover) an engine replacement.  Or was that it doesn't cover engine replacements under certain conditions which have been met in this case?

    You really need to establish the root cause of the failure.
    It is not possible to blame the service works and blame the car as being faulty (or developing fault) at the time of purchase.
    If the root cause is something that was done during the service, then this is not a matter for the retailing dealer to resolve.  Pursue the service garage.
    If the root cause is a fault (or developing fault) at the time of purchase, the timing with respect to the service may be coincidence and the claim would be with the supplying dealer.

    Why are BMW saying the warranty does not cover it?

    Did you pay any of the purchase on CC or finance?  Was the purchase price above or below £30k?

    I think the implication of the above was that the repair costs were uneconomic.

    I think spending £30K on a 7 year old cars is a massive risk personally especially with an insufficient warranty.
