Laptop out of stock?

Options
Hi,
I'm unsure what my rights are on this.
I bought a laptop online at scan.co.uk
They had a problem on their system so they only had one left in stock that been used as a demo machine at their reception.
I was offered to get that one for £50 off.
It now looks like they are unable to get any more of the model I ordered in.
The one I ordered was discounted £700 so a similar spec will cost more than I paid.

Can I expect them to provide me with another model of at least same spec without having to pay the extra cost of the new model?

Would I have a say on the brand? As in the spec might be the same but it's a "cheaper" brand, less build quality etc...?

I would prefer a laptop of equal or higher spec rather than a refund, is this my choice or theirs?

Any advice would be greatly appreciated.

You seem to have missed out the middle of the story that explains why you want or need another one, having already bought the ex-demo one - has the one you bought developed a fault or faulty on arrival perhaps?

Apologies you are right. I can't seem to edit my original post to amend.

I declined the demo model as I paid for a new one and didn't want a used one.

Oh right, I'd formed the impression that you'd accepted their offer.

Their Ts & Cs outline this:
    a) Making an agreement to purchase our goods
    • The market in the goods is such that the specification, description and price of individual goods can change
    • The invitation to you to order goods from us is not an offer by us to sell to you goods of the specification and description at the price indicated.
    • Your order is an offer to us to buy the goods of the specification and description at the price indicated.
    • Wherever possible we will accept your order to buy the goods of the specification and description at the price indicated by e-mail and in which case there will be a concluded agreement between you and us.
    • Wherever it is not possible to accept your order to buy the goods of the specification and description at the price indicated we will advise you by e-mail and offer to sell you the goods of the specification and description at the price stated in the e-mail and will state the period for which the offer or the price remains valid.
    • You may accept our offer by e-mail within the period stated and in which case there will be a concluded agreement between us.
How far through this offer and acceptance process did you get?

I can see why you thought that, apologies.

I didn't get very far in the process.
They discovered the only had the demo model and offered that to me for the £50 discount. I declined and said I was happy to wait until they got a new one in stock.
A few days later the model I ordered changed status from awaiting ETA to end of life can no longer be ordered.

I have yet to hear from them after this, but emailed them asking what the way forward is and what model I could get.

Sounds like a clearance and sadly you was too late. Either go for the ex demo they offered or it's a case of carry on looking for a bargain.
