The National Business Crime solution

I ordered 2 things from House of Fraser but only 1 arrived, they are adamant that it was delivered and that they have CCTV proof of this which they refused to share. The roundly rejected my claim after approximately 2 months of back and forth I went to my bank who refunded me. Other than the picture I sent of the contents of my parcel, I can't prove a negative. This was back in April 2024.

I have today (7 months later) received an email from The National Business Crime solution (below) advising that they are preparing to pursue this claim in the County Court to recoup their losses of £389. Any thoughts or advice on this would be greatly appreciated.

We email with reference to the above store who is a member of our organisation.

We are instructed that on 15/04/2024 you unlawfully committed fraud totalling £65 by claiming that you had not received goods / retained goods that were in fact delivered successfully.

As a result of your actions our member has suffered a loss totalling £389 and is preparing to pursue this claim in the County Court to recoup their losses.

This action will result in further charges being added to the outstanding amount and can lead to a CCJ being recorded against you.

 You can avoid court action now by paying the outstanding amount.

 It is important to note that the National Business Crime Solution is a Not-for-Profit organisation, with the aim of reducing business crime for our members. We do not seek to profit from the cost of this recovery. Therefore, we willreduce the amount payable to £339 if payment is made in full within 14 days of the date of this email. Failure to make the specified payment in 14 days will result in the full amount of £389 being payable as outlined above.

A follow up letter to your address will be sent 7 days from today’s date if no payment is received.

You are advised to seek independent legal advice from a solicitor or organisation such as the Citizen’s Advice Bureau should you be in any doubt at all as to your legal position.     Thank you. Apparently they represent 43 different companies such as Sports Direct, Next etc

    There was another thread on this a while back.

    You could tell them to whistle. 
    But end of the day, they can take you to court & get a CCJ issued against you. (Subject to judge agreeing with them & not your defence)

    Chargebacks have no legal standing. They could have contested the chargeback with proof of deliver & they would have won & you would have been re debited by the bank.
    As they did not, they now take the legal route to claim their funds.

  • This has literally happened to me today!  Similar story - ordered things and 1 was missing… ive been arguing with them but then requested a chargeback which was not paid to me as they’ve contested the claim.

    And like you don’t know what to do…

    think I’ll issue both companies with data subject access request to obtain any investigation documents emails, phone calls etc where my order, case or name was mentioned to start with… but don’t know what to do next…
  • Hi, have you received any updates from them? I have received the same letter and my due date to pay was 21 of november. I have received my second letter until now. I am from Ireland and since they are from UK I have no idea what they can to over here. I have contacted FLAC and the person I spoke to told me that if it was her case she wouldn t be paying the amount and if they go to court I should show up and the judge should decide.
