County Claim Form Received

My wife had a minor bump in a car park in June, we notified insurers etc. Today I received a county claim against me (as the insurance policy is in my name). asking for around 2.5K with interest accruing at a daily rate of around £65 a day!

Any idea why this has come to me and not my insurance company?
It's just my opinion and not advice.

Just forward it onto your insurers and let them deal with it. It's what you pay them for.

It should have gone to your wife as the driver, ultimately tell your insurers, they'll ask you to send it to them and do so without material delay.
  • Thanks both, I have sent it to my insurer hopefully that is the last I will hear of it. I will chase up in a couple of days to ensure it is actioned

Do I need to do anything else? the accrual rate for non payment is a little worrying 😟

Should really be your wife - but anyway it goes to the person (allegedly) responsible for causing the accident as ultimately liability lies with them. They can't take your insurance company to court directly, unless they are claiming that your insurance company damaged the other guy's car. Instead they take the driver to court, and the driver has to ask their insurers to deal with the claim on their behalf.

Which your insurer will - the policy says it will cover your liabilities to other people. That includes liability for accrued interest and the like - so the accrual rate is your insurer's problem, not yours. Ultimately it will be them putting their hand in their pocket at the end of the day, not you.

Thks, that puts my mind at rest a bit. Still don't understand why they sent the claim to me rather than direct to the insurers.

As explained above, the claim is legally by one driver against the other driver (even if in practice it's their insurance companies pulling the strings).
