Thanks you so much for your help leading to this.

Sadly I lost the case today.

The judge didn’t go for either of the preliminary points I made. He said that the POC was adequate in that it stated the location and the date as well as my registration.

He said that the agency advocate could continue as it was his distraction, to block her now would be a waste of the courts time.

I gave my defence he obviously didn’t believe it wholly.

I argued about the double recovery which he did take into account and refused it.

So he awarded the pcn, plus fixed fees totalling about £165 to the claimant. He did not award any advocate fee (£150 plus vat).

He then looked at costs reserved and awarded me 50% of the set aside fee.

All in all I have to pay out about £12 and change.

I’m thankful it’s over but feel gutted that I didn’t get the case.

That's a shame but we always knew your case against the PCN wasn't the strongest. The important win was the CCJ set aside and getting 50% costs awarded (shame it wasn't all those costs).

    🙂

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
