Hi all.
Really need some advice - have read previous threads and I'm completely confused as to what should happen next!
PCN received on 6.10.23 for a charge made on 4.10.23.. Residential parking with permit in car park.
My autistic son parked his car with his permit in the boot of his car taped to the window. He did this as the front windscreen was not accessible due to a fence at the front of the parking space and the parking spaces being very tight, so for ease to help the ticket warden he put in the boot windscreen.
He received a pcn. He ignored this. It has gone through to now receiving an evidence pack from Gladstone.
The evidence clearly shows the permit in the rear window, they have included signage which states it has to be in front windscreen.
I have driven to said car park and also taken photo of signage as it was as expected they have blown up the sign so it looks visible in the photos.
My question is what happens if this does go to court and my son loses, court fees?? Is it realistic that he will get off of this charge? Please help!
I have attached the photos i took last night in addition which clearly shows the small sign. This is the only sign in the whole car park and it is on the wall of some flats. The irony is no one else got a fine and no one was parking in the bays correctly which is also a rule on their sign!

They don't issue fines ( magistrates do. )
This was an invoice for the alleged breach of the parking contract
As the alleged debt is discounted, the victim should eventually receive a Letter of Claim, prior to any court claim, this would need to be responded to, as explained in the second post in the newbies sticky thread in announcements
After that happens, its likely that Glads will issue a court claim pack from the CNBC in Northampton using MCOL
Various procedures are followed by both sides, until it may end up in your relatives local civil court, where a judge can decide
If its only a single PCN, then if he lost in court the likely total to pay would be circa £212 to Glads

Yes! No risk. Not huge costs. It is no biggie to defend this. Easier than an appeal!
Except try Plan A first (complaint to the Managing agents).
What's the logo on the Tenants Parking Only sign? The parking is offered by whoever's logo is on that small sign. Is it the Managing agents? Complain to them immediately.

It is now magna housing. I'm not sure this was who it was when he was staying there as over a year ago! But worth a shot. Thanks0 -

It's a big ask for them to get damages for breach of contract where a permit was displayed and quite possibly paid for.
Is there a contemporaneous photo with permit in place in either yours or their images?1 -
