    As Horizon have updated their paperwork I am unsure about using the "still not comply with PoFA for 28 day misstated" response.
    Who said? Not AFAIK.

    Why are you using the awful version in the MSE guide which is long overdue a revamp?  Bin it.  That isn't the forum template!

    hi @Coupon-mad (and anyway else who assist)

    Ok so think I’m getting a handle on this but just need some clarification please.

    Plan A:

    I do not live close enough to the retailer to pop in and see if they will cancel the PCN via Horizon.

    I have though contacted the retailer and they have messaged me to say they will assist me if Horizon do not drop the charge (as I was using their facilities). But I have to go through the appeal first.

    Plan B:

    My Horizon PCN is one of the new ones so is poFA compliant I believe so the ‘non poFA’ template route is closed to me.

    so what is my best choice now when I appeal to Horizon please? Use the 28 day misstate as discussed in the linked thread as part of my Horizon appeal ? (although andromeda24 in the link was turned down for this)

    Or is that for Popla stage only?

    Or use the one size fits all template (attached that I think is correct) as you point out I’m using the wrong one.

    Im learning loads off the forum and you guys but just need that confidence to know that I’m doing the correct thing!!

    I just want to go with whatever route will get me off from the money grabbing scumbags lol.

    Help please. Not sure if I’m overthinking it all but as I want to get things right I’m still looking for a nudge in the right direction thanks.

    My original plan to appeal is apparently an old MSE devised template. I had another look yesterday so can someone confirm that I’m going in the right direction thanks (post above this). 

    Just unsure what my plan B should be as explained above.

    We did a shop in the specified Tesco and then spent approximately 3 hours after meeting friends at the instore Costa Coffee Cafe as valid customers. 
    Leave that out. That will provide Horizon with every justification.  Not that any of it really matters as you know it will be rejected, don't you?  Parking firms make no money by allowing appeals. 

    Then, get Tesco to honour their part.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I apologise for repeating myself but I am confused going by your comment on the thread linked earlier on here (shown below) where you say it is POFA compliant (I have same Horizon NTK).

    So I am struggling to understand what is my plan B to Horizon now (already contacted Tesco plan A).

    Seems I have several options:

    -The one you are pointing me to above is the 28 day misstate (which I now understand how it works). Do I use that as the go to appeal to Horizon now or is that to be saved for POPLA? I say this because andromeda24 in the linked thread had his appeal rejected for the 28 day misstate if I understand that properly. If I’ve misunderstood I apologise!!

    -Or if you are saying the new Horizon NKT  is non compliant still do I use the long used non POFA statement below that seems to be popular and successful.

    (" This is an appeal by the registered keeper - No driver details will be given. Please do NOT try the usual trick of asking for driver details in order to get around the fact your NtK does not comply with PoFA. As there is no keeper liability, therefore, liability cannot flow from the driver to the keeper and so, is an automatic win at POPLA. Please cancel the notice or issue a POPLA code at which point you will auto withdraw." )

    -Or the template appeal with because Tesco have said they will assist if Horizon rejects the appeal

    -Or use combination of all 3.

    I think I understand all the options but cannot work out which is priority for the appeal to Horizon or if rejected, the POPLA appeal.

  • Cheers @Coupon-mad, I do appreciate your time especially this late. I’m just bit of a worrier and want to dot the i’s and cross the t’s lol. 

    So I will save 28 day misstate for POPLA,

    Re depending on whether POFA is compliant or not, does the popular reply below still apply to the new updated Horizon NtK?

    That appeal can see Horizon cancel.  If you haven't sent the first appeal yet, send that.
