Do I need planning permission?

Hi, can anyone help. Both neighbours are on higher ground and the banking edge of my land was of similar hight but the house is in a dip. Historically the house was the drive of the big house that owned all the land the estate was built on. I thought the natural ground level was measured from either side of the banking. We then levelled the land and built a wall at the side of the house to the boundary. It is 1.9m from the neighbours ground which was my original banking but from the level land on my side it’s now 2.4m. The council say I need planning, but I’m confused, should I not have taken the measurements from my original banking.0
