  • Hi 101Labradoodles. I am in an almost identical situation to you and have just received an LOC from Mooreside Legal.
Did your case go to court and what was the outcome if you don’t mind me asking?

No Moorside cases have got to hearings yet as they are new, and their claims are useless.

Just for those following, a quick update on my case... I had my mediation call last week and a settlement was not reached. On the call, the mediator first told me their claim is I was parked in a no stopping zone (they obviously know the alleged breach but didn't include this in their PoC) and then asked me about my defence which I advised the main part is the PoC are inadequate. They asked if I was willing to offer anything to the claimant to settle outside of court, I advised I do not believe I owe anything in regards to the claim, however, to save mine and the courts time I was willing to pay the claimant £20.
The mediator spoke to the claimant and got back to me to say they advised they would be willing to accept £100 as 2x £50 payments. I stated this is the same as the original fine which I do not believe I owe them and therefore declined. They were unwilling to go lower than this stating that they had incurred court costs to get to this stage. Therefore, a settlement was not reached.

I believe the claim will now be transferred to my local court.

You should have told the mediator you've incurred costs too...YOUR TIME WASTED seeking out advice and learning how to write a defence in response to their court claim. A claim that ML have no intention of taking to a hearing. A claim ML will likely discontinue just before they're due to pay the hearing fees.

Following this as I'm in the same situation, sent in my defence via email on the 30th April and waiting for it to be added to my MCOL account. Had a call and a letter through this morning from Moorside asking to set up a payment plan/pay up, ignored the phone call.
Please keep us updated with what happens next 101labradoodles, keen on knowing how far Moorside are willing to go with this.

They'll discontinue. They are copying the DCB Legal model (one of their principal solicitors used to work at DCB Legal & she's brought that questionable bulk litigation MO with her including the copied POC).

In your opinion coupon-mad, if this does happen how you think and just before they're due to pay the court fees they cancel the claims, is it worth chasing costs if we've had to take time off work etc? Or is that potentially a headache too far for most?

Up to you, but the NEWBIES thread already gives an example of how to try.
