Car Parking Charge Notice

Hi all, after two years of receiving letters from various third party debt collectors, I’ve now had a County Court letter come through (DCB Legal) - I believe I have a case to contest this charge as I have paid. Previously they’ve stated they won’t provide any other information until court. Where do I stand with a CCJ if I did lose in court? Does that get implemented straight away? Do you get the option to pay before they do that? 

Obviously that’s the only thing putting me off fighting it. 

Any advice would be appreciated

    If you lose in court of course you get time to pay up.
    If you pay in full there is no CCJ registered.
    That amount claimed also seems to include debt collection fees which are not allowed, at the moment you have no debt, so nothing has been collected, and if it goes to court the debt collector can't take you there only the PPC can.
    Many fight these idiots with help from here and win, but you haven't provided much info.

    Sorry for not providing much. 
    Basically I entered the car park at 2:47pm. I had my 2 week old son in the car who had been sick in the car. (Was obviously sorting him out first before paying + paid on the machine but people were in front. So I don’t think I paid until 3:07pm. I paid for 2 hours 3:07pm-5:07pm but after an hour knew we were going to be longer. Walked back to the car park and used the app to pay for an extra hour 5-6pm. I then leave the car park at 5:45pm. 

    I can only think they’re trying to get me on the time I first entered to when I purchased the ticket using the machine.

    Get the AoS done online, by logging into MCOL 

    After that, start adapting the template defence by coupon mad in announcements, altering just a few paragraphs ( then show us just those paragraphs that you adapted, do not post the rest of the template, only your homework 

    Study other recent ECP DCB Legal cases for inspiration, only ones from this year, nothing older

    And we see wins 99% of the time.

  • No doubt Euro Car Parks will be claiming you did not pay quickly enough and failed to meet the terms and condition on their sign. Often 5 or 10 minutes.

    You could include in your defence that attending to a very young baby was a small vicissitude as used in the court case Jopson v Homeguard. Google it

    With a Claim Issue Date of 29th October, you have until Monday 18th November to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 2nd December 2024 to file a Defence.
    That's almost four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
