DBCL issued a CCJ via the courts

I parked my car in the residents car park where I lived at the time. BaySentry Solutions issued me with a £100 penalty notice, which I contested immediately. BaySentry Solutions didn't notify me of my right to contest the fine externally through the Parking on Private Land Appeals. One month later DBCL (DBC Legal ltd) pursued me for £170 for the parking notice. I told both companies that I wanted to contest this in court. I also told both companies that I had just changed my address, giving them my email and new address. DBCL took me to court, giving the court my old address. As a result, I was unaware of the court case so the court ruled against me in my absence. The court issued me a CCJ for £285 despite the parking fine being £100. I'm appealing to the court to Stay the Writ and set aside the debit pending a court hearing. However, until the court responds by credit file is negatively impacted. I believe that DBCL purposely gave the court my old address so the court would rule against me in my absence. I would like help in understanding what recourse I can take against DBCL as they deliberately gave the courts my outdated address. Please help.

    No you are not applying to 'stay the writ' because there is no writ.

    That's only where a case exceeds £600 and DCB Ltd HCEOs get their grubby hands on it. Not for a single PCN case. No writ exists.

    I hope you DIDN'T just put 'stay the writ' as your only reason for your application. I hope you also put 'set aside the CCJ and dismiss the claim'?

    You will win as long as you evidence all of the above and the house move. Have you already sent a witness statement with your N244?

    Thank you for responding!

    I wasn't aware that Writs only come into effect above £600. I also wrote set aside the CCJ.

    BaySentry Solitions has now apparently discontinued their court claim and DCB Legal are writing to the court to remove the CCJ. I recieved an email from DCB Legal to that effect.

    Hopefully this is the end of it. Both companies seem dodgy as hell.

    How much are you out of pocket for your n244 application? Did you pay £15 or £303?

    If it is a private parking firm:

     - your son does not have a 'fine'

    and

    - it's not £180

    and

    - there will not have been 'no signage'.
