Action Against Local Water Authority

Hi,

Our LWA's defective drains have caused subsidence at our property.  Our insurance claim has been pending since February 2023 because the LWA will not take responsibility and repair the drains.  They are claiming their drains are not cracked/fractured or leaking.  We have evidence to prove otherwise, including their own EIR report.  The CCW cannot help.  How do you hold these companies to account?  Can we take legal action against them as advised by the CCW?

The LWA are leaving our property exposed to risk of further damage.  In addition the subsidence may devalue our property and affect any future sale because of the risks associated with the defective drains.  

Surely there must be a way to hold these privatised companies to account!  Apologies if there is already a live thread on this topic.

    I would have thought you would claim on your property insurance. 

    Your insurer has the skills and resources to investigate root cause and pursue the repair by third party (water company) if appropriate.

    Your insurer can also effect the repair on the third party asset or take other action to prevent the damaged drain from causing further detriment to your property.

    Your insurer has the means to recover costs from the water company after the event.

    Not all work on the network has to be carried out by the water company.

    The OP mentions they have claimed from their insurer but things don't seem to have progressed.  What update has the insurer given?
    I certainly think this is worth pursuing the insurer to resolve and let the insurer use their might to recover from the water company.

    It sounds like you need to chase your insurer.  That's what they're there for.  Why have they allowed this to drag on for almost two years?
