County court judgement issued- advice

Hello.

Just after a bit of advice (I've read the newbies FAQ)

I've buried my head in the sand. And here we are. 

Recieved a claim form(with the response pack) for a parking ticket (DCB legal).

I went to the land owner and got the ticket cancelled (land owner being NHS, company managing car park - parking eye) 

I thought that would be the end of it.

Hindsight tells me I should have responded to the claim form. I didn't, as thought once the company had said the ticket was cancelled,  I would be OK.

I've received a judgement for claim - they had no response from me. Which says I can pay and not have the CCJ recorded (I have 14 days left to pay (I've been away).

I understand I can file a N22 - which costs almost as much as the claim. 

My questions are:

Should I pay now, and try and get the money back from the company- after having emails about the ticket being cancelled.

If I did start an N22 - have I lost that window of not having the CCJ on my record as I only have 14 days left to pay.

    N244 surely.

    I'm not an expert on the claims but know the NEWBIES thread has guidance on setaside and reclaiming the fee

    @fatbelly is correct, it is N244 and the NEWBIE sticky has good guidance on set-asides.  This costs £303.  We do not recommend paying the alleged debt as that removes any leverage you have over the parking company.  What will be your main thrust for getting the CCJ set aside?

    DCB Legal would never have known that the landowner had decided to cancel it.  Clearly you had to respond to the claim form to avoid a CCJ.

    Now you will have to apply to set it aside.

    Same as ever, you have grounds under CPR 13.3 : your 'some other good reason' is that the PCN was confirmed cancelled before judgment was entered.  And you have good prospects of a successful defence.

    Easy.  And the C should be ordered to pay back your £303 for obvious reasons.
