Driver's name asked at the car park entrance


Have received Parking Charge Notice from UK CPM for 2 different occasions. The car park employees ask for the driver's name and note it down alongside the car registration number on entry.
What is the downside that the driver disclosed their name upon entry?

Knowing the name of the driver significantly helps the parking company should they wish to send a PCN anywhere.
Never heard of that happening before.

Ask them for your data as per GDPR and them tell them erase it as they have no just cause to retain itFrom the Plain Language Commission:

Which operator? The practice of collecting the driver’s name without providing clear information or justification is a straightforward breach of GDPR.

No Lawful Basis: GDPR requires a lawful basis for collecting personal data. Since the collection of a driver’s name isn’t necessary for managing the parking facility, and the operator can rely on PoFA if pursuing liability, there is no legitimate reason to request and record this information.
Failure to Inform: GDPR mandates that individuals be informed of the identity of the data controller, the purpose of data collection, how their data will be used, and their rights. This information is required at the point of collection. In the absence of these details, the collection is unlawful.
Transparency Violation: The operator is violating GDPR’s principle of transparency by not providing a visible notice or explanation. Personal data collection without transparency is a clear breach.
No Cause of Action: Under GDPR and PoFA, a parking operator is permitted to only request keeper data from the DVLA and only after a contravention has been identified. Collecting driver details preemptively, before any breach may have occurred, lacks any legitimate or lawful basis.
Unlawful Processing of Personal Data: For personal data collection to be lawful under GDPR, it must be necessary, transparent, and have a legitimate purpose. Since no contravention has occurred, there is no lawful basis for collecting the driver’s personal details. This makes such data collection illegal and a clear breach of GDPR.
Infringement of GDPR Principles: Collecting driver information before any incident fails to meet GDPR’s principles of lawfulness, fairness, and data minimisation. The data collected must be relevant and limited to what is necessary—preemptive collection before any alleged breach is excessive and unjustified.
In short, collecting the driver’s name without these disclosures is unlawful. The operator should rely on PoFA to pursue liability through the keeper if needed.

Looks like a business center, where people work from so may be doing it in case they need cars moving. Or to check that it is being used by people working in the building rather than people simply using it for parking.Life in the slow lane0

Visit was for an appointment at the Indian Visa application centre and the visitor parking is at the rear of the building. They didn't say why they were asking for the name.
