BARCELÓ HOTEL GROUP TRAVEL TRENDS CAMPAIGN RULES

ONE. - Company behind the giveaway

The company BARCELÓ GESTIÓN HOTELERA, S.L. (hereinafter BARCELÓ or the Promoter), with

registered address Calle Josep Rover Motta 27, 07006 Palma de Mallorca (SPAIN), and NIF B-

07918287, organises this Travel Trends giveaway to streamline the Barceló Hotel Group's

hotels on social media.

TWO. - Participation period

The participation period for this giveaway will begin on 31/10/2024 and end on 09/12/2024.

The Barceló Hotel Group reserves the right to suspend, postpone, cancel or modify the

aforementioned participation period as long as there are reasonable causes and by making a

public announcement via the www.barcelo.com website and social media.

THREE. - Eligibility restrictions

Eligibility

This giveaway is open to individuals over the age of 18 years. This giveaway excludes any

participants who submit false or inaccurate information, or who generally do not comply with

the terms specified in these Rules. Regardless of their exclusion, the organiser reserves the

right to undertake any legal actions deemed appropriate against those who violate these

Rules.

Participation in this giveaway is free of charge and open to all users who comply with and

agree to these Rules.

Exclusions

Participation in this giveaway is not open to employees (or their family members, up to

second-degree relatives) of BARCELÓ GESTIÓN HOTELERA S.L.; of the associated companies,

advertising agencies and promotional agencies linked to the giveaway; or of the companies

involved in this giveaway.

FOUR. - Geographic scope.

This international giveaway is not limited to the residents of a specific country.

FIVE. - Prize descriptions.

This giveaway will include 1 prize for 1 winner who will be notified during the week of 02

December 2024 via the social media channels (Facebook and Instagram) of Barceló Hotels &

Resorts.

The prize will consist of:

● A two-night stay for two guests, with breakfast included, at any Barceló Hotel Group

hotel in Europe or North Africa.

● The prize does not include airfare or any form of transportation, only the hotel stay at

one of the following Group brands: Barceló Hotels & Resorts, Occidental Hotels & Resorts

and Allegro Hotels. This giveaway excludes Royal Hideaway hotels. The hotel stay must be

used before 30 June 2025, and the following dates are excluded from the giveaway: Christmas,

New Year and Easter break.

The prize will automatically and definitively expire:

- If the winner does not claim the prize via social media (Barceló Hotels & Resorts profiles)

within 10 days after the winner is notified.

- In the event of cancellation.

To redeem the prize, the winner must book the corresponding dates (check-in and check-out),

which are subject to hotel availability.

- The Promoter is not liable for how the prize/incentive is used by the winner.

- Renouncing the prize will not result in the right to compensation.

- The incentives are as described in these rules.

- The prize may not be redeemed for its equivalent financial value and nor be modified or

altered at the winner’s request.

The participant agrees that the Barceló Hotel Group will not pay fees, expenses or

compensation of any type, other than the prize that has been agreed upon for the winner of

the giveaway. Specifically, and by way of example but not without limitation, this refers to the

cost of transportation, extra or additional services, meals (if they are not included as part of

the hotel accommodation package), and fees or charges associated with the stay in question

and not linked to the applicable accommodation package. These items must be paid by the

winner of the prize, and the Barceló Hotel Group and the applicable hotels are exempt from

any related obligations.

The participant who has received a prize may not transfer it to a third party in any manner. To

this end, the winner must be directly and personally included as a guest in the booking, unless

expressly authorised by the Barceló Hotel Group.

SIX. - Process

The process to participate in this giveaway must be in accordance with the following:

Users must complete the following steps to participate:

- Several posts will be published on the Facebook and Instagram profiles of the corporate

account and of Barceló Hotel Group hotels.

- To participate, users must follow the link that appears in the Facebook and Instagram posts.

- Users must then fill out the questionnaire via EasyPromos.

- Their participation will be registered automatically.

Users may only participate once in the giveaway.

(i) The winner must specifically make contact to claim the prize within ten (10) days after the

winner is notified, and

(ii) provide their complete information (name and surname/s, nationality, date of birth,

address, phone number, passport or national ID number, email address, and any other

information that the Barceló Hotel Group may request) to verify their identity and confirm

their compliance with the legal terms and conditions.

Once these items have been successfully verified, the Barceló Hotel Group will ask the winner

to suggest dates for redeeming the prize.

By agreeing to these legal terms and conditions, the winner’s name may be published by the

Barceló Hotel Group in any of its channels and/or in the social media accounts during the

fifteen (15) days after this giveaway has ended.

To receive the giveaway prize, users must comply with any of the participation methods

described.

To receive the prize, the winner must comply with the terms specified in these rules and the

information submitted by the winner to the Barceló Hotel Group must be accurate.

The Barceló Hotel Group reserves the right to remove and automatically expel, without prior

notice, any participants it deems to not comply with the participation terms or who are

abusing or making improper use of the giveaway.

SEVEN. - Personal data.

I.- Who is the data controller?

The data controller is Barceló Gestión Hotelera, S.L. (hereinafter, ‘BGH’), with registered

address Calle Josep Rover Motta 27, 07006, Palma de Mallorca (Spain). Any questions

regarding data protection may be submitted to the BHG Protection Office via email at

dpo@barcelo.com.

II.- Why do we process your data and what are the legal grounds?

BGH informs users that their data will be processed by Barceló for the following purposes:

• Registering in the contest or giveaway for which users submit their personal data. BHG

will process the data submitted by users in the registration form for the contest or giveaway to

run the contest or giveaway. This includes communicating with the winner and coordinating

the prize’s delivery, if applicable.

Lawful basis: This processing will only occur if BGH has the user’s consent, which is granted by

filling out and sending the registration form for the contest or giveaway. Users may withdraw

their consent by following the instructions specified in section V.

• Sending marketing correspondence for BGH products and services, or those of its

group entities. If BGH obtains a user’s consent, BGH may send marketing correspondence to

the user for its products and services, or those of its group companies, that may be of interest

to the user and via any medium (particularly e-mail and SMS).

Lawful basis: This processing will only occur if BGH has the user’s consent, which is granted by

filling out and sending the registration form for the contest or giveaway. Users may withdraw

their consent by following the instructions specified in section V.

III.- How long will we keep your data?

The personal data obtained will be processed and stored during the required period to comply

with the purpose for which it was collected (running the giveaway). After this time, BGH will

keep the personal data when it is no longer pertinent to the purpose for which it was

collected. The data will be blocked accordingly and made available to the corresponding public

authorities, judges, courts and the tax administration during the required period for any

actions that may result from the relationship with the user and/or the legally required storage

periods. BGH will physically delete your data at the end of these periods.

If the user has granted their consent for the processing activities listed in this clause, BGH will

keep their personal data as long as the user does not withdraw that consent by following the

steps listed in section V.

IV.- Who will we share your data with?

BGH may share user data with:

• The corresponding public authorities, judges and courts.

• Service providers: BGH works with third-party service providers that have access to

users’ personal data and who process this data on behalf of BGH as part of the services they

provide. Specifically, BGH will hire third-party service providers that operate, by way of

example and without limitation, in the following areas: legal, multidisciplinary professional

services, technology services and IT services. One of these service providers is

FLYMETOTHEMOON, S.L.

V.- What are your rights when providing us with your data?

Users may exercise their rights of access, data rectification and erasure, restriction of

processing, data portability and objection to individual automated decisions through the

following mediums:

• By sending a written request to the address listed at the top.

• By sending a request via email to dpo@barcelo.com.

With regard to data processing based on obtaining consent, users may withdraw their consent

by following the steps listed in the previous paragraph.

VI.- How did we obtain your data?

The personal data processed by BGH is provided by users when they fill out and submit the

form to participate in this contest or giveaway.

VII.- What authorities may you file a complaint with?

Users may file a complaint with the Spanish Data Protection Agency (Agencia Española de

Protección de Datos) based on the response received from BGH regarding their rights.

Users are hereby notified that personal data processing complaints will be processed by the

Data Protection Officer of Barceló Gestión Hotelera, S.L., located at Calle Josep Rover Motta

27, 07006, Palma de Mallorca (Spain), or by sending an email to dpo@barcelo.com, attaching

the corresponding request along with a copy of their DNI national ID, NIF tax ID or another

official document that confirms their identity.

EIGHT. - Participation via social media.

Facebook and Instagram do not sponsor, endorse or run this giveaway in any way, and they

are not associated with it. Thereby, it is specifically confirmed that Facebook is in no way

related to this giveaway.

Participants exonerate Facebook and Instagram of any liability derived from this giveaway.

Users will be liable for their comments and/or posts, thereby exonerating the Barceló Hotel

Group of any liability derived from the content submitted by the aforementioned users.

Allusive posts and/or those with sexual, violent, degrading, racist, discriminatory or

defamatory content, in addition to threats or insults that could offend the average person or

incite illegal action, will not be permitted. Additionally, posts that violate intellectual and/or

industrial property rights, privacy rights, or any other third-party's right will not be permitted.

The Barceló Hotel Group reserves the right to delete posts and exclude any users whose posts

show inappropriate content, and to inform Facebook accordingly.

All the participants of this giveaway confirm that:

(i) they hold all the usage rights for the intellectual property of any images or photos they post

publicly and submit within the framework of this giveaway, or they have the express consent

and/or license, granted by the holder of those rights, and therefore the publication of images

within the framework of this giveaway does not violate the rights of third parties;

(ii) the aforementioned publication complies with the legal limitations and measures defined

by the Organic Law 1/1982 of May 5 for the Civil Protection of the Right to Honour, Personal

and Family Privacy, and One’s Own Image, and in particular, that the participant has obtained

prior and express consent from all the people who appear in the photos (or that of their

parents, guardians or legal representatives in the case of minors) to publish and distribute

those images within the framework of this giveaway.

NINE. - Limitation of liability.

Among other aspects, the Barceló Hotel Group is not liable for:

- The winner’s use of the prize.

- The services that third-party businesses may render for this giveaway.

- Any errors or incidents in the telecommunications systems that hinder access to the

application or its normal use.

- The operation of the EasyPromos app. It will also not be liable for its privacy policy,

registration terms & conditions, personal data protection and intellectual property. Before

submitting or posting anything on EasyPromos, users are advised to carefully read its terms

and conditions.

TEN. - Reservation of rights.

The Promoter reserves the right to remove any participants who are using the giveaway

improperly, carrying out actions that are fraudulent or may harm other participants, or

establishing speculative or business systems. If the Barceló Hotel Group or an entity that is

professionally linked to this giveaway detects anomalies or suspects that a participant is

interfering with the standard course of the giveaway by illegally altering records through a

technical or digital method, or is carrying out any fraudulent acts that affect its transparency,

the Barceló Hotel Group reserves the right to cancel or remove the prize automatically and

without any type of explanation from the participants who have directly or indirectly benefited

from these types of fraudulent acts, notwithstanding its option to exercise all the

corresponding civil or criminal actions.

In this sense, the Barceló Hotel Group states that it has established suitable technological

systems and mechanisms for detecting any potential fraudulent acts, anomalies or intentional

acts that aim to impact normal participation in this giveaway, such as individuals who register

in the giveaway using multiple Facebook profiles.

The Barceló Hotel Group reserves the right to take legal action against individuals who perform

any acts that could be construed as tampering with or falsifying the giveaway.

The Barceló Hotel Group is exempt from liability for damages of any type that may result from

the temporary unavailability or interruption of the services that support participation in the

giveaway, the fraudulent use of those services by other participants, and specifically although

not limited to, errors in accessing the pages and in sending participation replies via the

Internet, or phone communications established for this purpose.

ELEVEN. - Other considerations.

The prize for this giveaway will be subject to the applicable tax regulations. These applicable

regulations may classify the prize as taxable income, depending on the location of the winner’s

residence and the value of the prize. In any case, the winner is solely responsible for reporting

and paying all applicable taxes related to the prize. In accordance with Spanish tax legislation,

the prizes given for participating in this type of contest are not subject to withholdings or

payments on account as long as the value of the prize is less than €300. In any case, the winner

will be required to fulfil any future tax obligations related to the prize.

TWELVE. - Acceptance of the rules.

Participation in the giveaway involves fully agreeing to these rules and expressly submitting to

the interpretive decisions of the Barceló Hotel Group. Notwithstanding the winner’s

acceptance via a digital format, the winner may be asked to provide a written document

confirming their agreement with all the terms and conditions of the giveaway.

THIRTEEN. - Modifications.

The Barceló Hotel Group reserves the right to make any changes, cancel or expand this

giveaway by providing sufficient advance notice.

FOURTEEN. - Applicable legislation and jurisdiction.

This giveaway is governed by the applicable Spanish legislation. For information about any

disputes that may arise regarding the interpretation or application of these rules, the Barceló

Hotel Group and the participants of this giveaway agree to the jurisdiction and authority of the

Courts of Palma de Mallorca, expressly renouncing their jurisdiction, without prejudice to the

mandatory terms specified in consumer and user regulations.

FIFTEEN. - Formalising the rules before a notary public.

The rules of this promotional giveaway have been formalised before the notary’s office of

Álvaro Delgado Truyols, Calle Unión 2 A in Palma de Mallorca (Spain).
